ORDINANCE NO. 2003 -020
AMENDING WHATCOM COUNTY CODE 3.05.010
WHEREAS, current statute requires that all tort liability claims be filed with the local
governing body; and
WHEREAS, Wbatcom County claims are currently fled with the legislative branch of county
government through the Clerk of the Council; and
WHEREAS, the Prosecuting Attorney has requested that the Clerk of the County Council
forward a copy of all claims filed against Whatcom County to the Executive's office.
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that Whatcom
County Code 3.05.010(D) is hereby amended as follows:
D. Claim Forwarded to the County Executive as well as the
Prosecuting Attorney. Every claim after being Sled with the clerk of
the county council shall be promptly forwarded to the Executive's
Office as well as the Prosecuting Attorney who shall consider same in
light of county tort claims defense qualifications.
