ORDINANCE NO. 2003 -003
AMENDING THE OFFICIAL WHATCOM COUNTY COMPREHENSIVE PLAN MAP FROM LONG
TERM PLANNING AREA (LTPA) TO SHORT TERM PLANNING AREA (STPA) FOR 90 ACRES
IN THE BIRCH BAY URBAN GROWTH AREA
WHEREAS, the Whatcom County SEPA Official issued a Determination of Non - significance
on October 3, 2002; and
WHEREAS, pursuant to RCW 36.70.590, legal notice was published in the Bellingham
Herald on September 26, 2002; and
WHEREAS, the Whatcom County Planning Commission held a public hearing on the
proposed amendment on October 10, 2002, and considered all testimony; and
WHEREAS, the Whatcom County Planning Commission recommended approval of the
rezone request from LTPA to STPA for approximately 90 acres within the Birch Bay UGA; and
WHEREAS, the Whatcom County Council finds this map amendment in the best interest
of the public health, safety and welfare, based on the following Findings of Fact and Conclusions:
FINDINGS OF FACT AND REASONS FOR ACTION
1. The applicant is requesting an amendment to re- designate approximately 90 acres
within the Birch Bay Urban Growth Area (UGA) from Long Term Planning Area (LTPA)
to Short Term Planning Area (STPA).
2. A Determination of Non - significance was issued by the Whatcom County SEPA Official
on October3, 2002.
3. Legal notice was published in the Bellingham Herald on September 26, 2002 and a
public hearing is scheduled for Thursday, October 10, 2002.
4. The subject site is adjacent to urban level development along Birch Bay Drive, is
adjacent to existing public water and sewer, natural gas, telephone and Gable tv
lines with adequate capacity, and has access to two improved County arterial roads.
5. Changed conditions include: updated population projections which project a
population considerably higher than contemplated in 1997, an update to the Birch
Bay Community Plan with plans for public services and facilities to serve projected
growth, a new water contract between the City of Blaine and the Birch Bay Water
and Sewer District, which will assure an adequate water supply for this site, and the
construction of a new sewer line along Point Whitehorn Road through the subject
site.
6. The amendment will allow the development of housing for seasonal and full time
residents to meet the demand for housing projected in the Whatcom County
Page 1
Comprehensive Plan and recent Birch Bay Community Plan.
CONCLUSION
1. The proposed map amendment is consistent with GMA goals, County -wide Planning
Policies, and meets the County Comprehensive Plan criteria for an unincorporated Short
Term Planning Area.
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that:
Section 1. The Official Whatcom County Comprehensive Plan map be amended from Long Term
Planning Area (LTPA) to Short Term Planning Area (STPA) for 90 acres in the Birch Bay UGA, as
shown on Exhibit 1.
Section 2. Adjudication of invalidity of any of the sections, clauses, or provisions of the
Comprehensive Plan shall not affect or impair the validity of the plan as a whole or any part thereof
other than the part so declared to be invalid.
