(X )Yes,( ) NO Requested Date: November 25, 2003 SUMMARYSTATEMENT: In previous years the sub zone assessment rate was tied directly to the County -wide flood fee. Now that the County -wide district revenue has been changed to a property tax levy, the Sumas /Nooksack/Everson Sub -zone formula has been reviewed and is recommended for modification. All revenue generated by the sub -zone is applied directly to projects completed within the boundaries of the sub -zone. This resolution will modify the formula for calculating fee rates within the sub -zone and will generate revenue for the sub -zone during 2004. The resolution is recommended for approval. Monsen Sheri Superior Court Treasurer Other Ordinance or Resoluli fthis item). p Number ei SPONSORED BY: CONSENT PROPOSED BY: PUBLIC WORKS INTRODUCTION DATE: j/5 /oa 4 5 6 A Resolution by the Governing Body of the 7 County-wide Flood Control Zone District 8 hereinafter referred to as the Whatcom County 9 Flood Control Zone District (WCFCZD) 10 11 12 RESOLUTION NO. 2003- 072 13 14 AMENDING THE CURRENT WHATCOM COUNTY 15 FLOOD CONTROL ZONE DISTRICT (WCFCZD) 16 FUNDING MECHANISM AND LEVELS FOR THE 17 SUMAS /NOOKSACK /EVERSON SUBZONE 18 19 20 WHEREAS, the WCFCZD was duly created by Whatcom County to provide 21 a governmental entity and structure through which to address flooding and achieve 22 flood damage reduction in Whatcom County; and, 23 24 WHEREAS, the Sumas /Nooksack/Everson Subzone was established, in 25 terms of governance structure, as traced thoroughly in the preamble to Ordinance 26 97 -051; and, 27 28 WHEREAS, Ordinance 97 -054 established the funding mechanism for the 29 Flood Control Zone District Subzones, amended by Resolution 99 -056 and 30 Resolution 2002 -053 to extend the service charge through December 31, 2003; 31 and, 32 33 WHEREAS, since it is the intent of the Board of Supervisors of the flood 34 control zone district that the activities funded through the Subzone be continued 35 for the next year, the district needs a continuing source of funding during that time; 36 and, 37 38 WHEREAS, the use of assessments is a proper funding mechanism for 39 Subzone activities; 40 41 NOW, THEREFORE, BE IT RESOLVED by the WCFCZD Board of 42 Supervisors that the funding mechanism for the Sumas /Nooksack/Everson 43 Subzone, be as follows: 44 45 39 40 41 42 43 44 45 46 Type of Parcel Unimproved, outside flood hazard area Improved, outside flood hazard area Unimproved, within flood hazard area Improved, within flood hazard area Sub -zone Fee $0.25 /acre $0.375 /acre $0.50 /acre Minimum Fee $5.00 /parcel $5.00 /parcel $5.00 /parcel $2.50 /acre Improved Minimum Value $25,000 - $49,999 = $30.00 /parcel $50,000 - $100,000 = $55.00 1parcel $100,001 - $300,000 = $75.00 /parcel greater than $300,000 = $200.00 /parcel Unimproved, part in and out of flood hazard area Prorated by area $5.00 /parcel $0.25 /acre out, and $0.50 /acre in Improved, part in Prorated by area Improved Minimum Value and out of flood hazard area $0.375 /acre out, and $25,000 - $49,999 = $30.00 1parcel $2.50 /acre in $50,000 - $100,000 = $55.00 /parcel $100,001 - $300,000 = $75.00 1parcel greater than $300,000 = $200.00 /parcel Fees for all parcels designated as "Open Space ", Classified Forest Land, Designated Forest Land and Non - commercial Forest and Forest Reserves will be reduced by 40 %. Flood hazard areas, for purposes of this resolution, are defined as those areas mapped as 100 -year Floodplains or alluvial fans as shown on the latest maps produced by the Federal Emergency Management Agency and being used by the County for administering the Flood Damage Prevention Ordinance. BE IT FURTHER RESOLVED that the following parcels are exempt from paying fees to the Suman /Nooksack/Everson Subzone: a. All parcels owned by the Federal Government, b. All parcels classified as Indian Lands held in trust, C. All parcels exclusively classified as mineral rights, d. All parcels owned by the State, classified as "bedlands or tidelands', e. All parcels with assessed value less than or equal to $2,500. APPROVED this 9th day of December , 2003.
