A Resolution by the Governing Body of the County-wide Flood Control Zone District,
hereinafter referred to as the Whatcom County Flood Control Zone District ( WCFCZD)
RESOLUTION NO. 2003 -065
MODIFYING THE WHATCOM COUNTY FLOOD CONTROL ZONE DISTRICT
( WCFCZD) FUNDING MECHANISM
WHEREAS, the WCFCZD was duly created by Whatcom County to provide a
governmental entity and structure through which to address flooding and associated surface water
management issues, and to achieve flood damage reduction in Whatcom County; and
WHEREAS, the boundaries of the WCFCZD are conterminous with the boundaries of
Whatcom County; and
WHEREAS, the development of the district, in terms of governance structure and funding,
are traced thoroughly in the preamble to Resolution 99 -058; and
WHEREAS, Resolution 99 -058 amended the funding mechanism for the activity of the
WCFCZD to extend the service charge through December 31, 2002; and
WHEREAS, Resolution 02 -051 extended the charge through December 31, 2003 and also
continued the direction of 50% of the revenue to the Water Resources Fund; and
WHEREAS, RCW 86.15.160(3) authorizes the Board of Supervisors of the WCFCZD to
impose an ad valorem property tax levy of up to fifty cents per thousand dollars of assessed value
upon real property within the district; and
WHEREAS, consideration of that funding mechanism by persons both inside and outside
of County government has led to the conclusion that a more appropriate mechanism for the future
funding of activities for both flood control and water resources programs requires a change in
either the method of collection from assessment to tax or in strengthening the connection between
the sources of assessment funds and the manner of their expenditure; and
WHEREAS, the programmatic approaches to be employed in the areas of flood control and
water resources call for a revenue collection method that best fits those strategies; and

WHEREAS, while the revenue to be raised in support of the flood control programs will
actually be less than in past years, the most appropriate revenue collection method under the
current circumstances for the general programmatic elements of flood control as authorized by
RCW 86.15, 86.12, 36.89, and 36.94, is by tax instead of assessment or service charge; and
WHEREAS, the imposition of assessments or service charges may still be appropriately
required for the financing of projects specially benefiting properties within subzone areas; and
WHEREAS, an ad valorem tax of $0.1937 per thousand dollars of assessed valuation upon
all taxable properties within Whatcom County appears to be sufficient to produce the revenue
needed for the financing of the general programmatic elements of those efforts to be conducted by
or through Whatcom County in 2004 as authorized by RCW 36.89, 36.94, 86.12, and 86.15;
NOW, THEREFORE, BE IT RESOLVED by the WCFCZD Board of Supervisors that an
ad valorem property tax shall be levied upon taxable real property within Whatcom County at the
rate of $0.1937 per thousand dollars of assessed value, for collection in the year 2004.
