Discussion of road vacation of a portion of Lunn/ View Drive/Lummi Shore
Road.
Public Works recommends approval of a Resolution of Intent to Vacate a Portion of
Lummi View Drive /Lunnni Shore Road.
Action on this item is directly related to another agenda item. A proposed
Resolution amending County Road Project No. 900905, "Lumrni View Drive" and
the Interlocal Agreement between Whatcom County and the Lummi Indian
Business Council for the Lummi View Drive/Lummi Shore Road Project 2.

RESOLUTION NO. 2003 -034
IN THE MATTER OF DECLARING THE INTENTION TO VACATE
A PORTION OF LUMMI VIEW DRIVE AND LUMMI SHORE ROAD
WHEREAS, a new roadway alignment has been proposed for a portion of Lummi View Drive and Lurnnu
Shore Road; and,
WHEREAS, the originally established right of way is proposed to be abandoned as part of the Lummi
View Drive /Lunum Shore Road realignment and a vacation of interest is in part a condition of acquisition of the
needed right of way; and,
WHEREAS, as described in RCW 36.87.10, when a county road or any part thereof is considered useless,
the Whatcom County Council may declare its intention to formally consider, by resolution.
NOW, THEREFORE, BE IT RESOLVED that it is the intention of Whatcom County Council to consider
vacation of the following described right of way:
Legal Description for a Portion of County Road #652 AKA Lummi Shore Road/Lummi View Drive
Said Vacation to be comprised of a portion of Cowry Road #652 AKA Lummi Shore Road/ Lummi View
Drive, as per the map on file with the County Engineers office titled Map of County Road #652, Dated Nov. 22
1928, lying in Government Lots 8, 9 and 10 of Section 2, Township 37 North, Range 1 East of W.M. and
Government Lot I of Section 11, Township 37 North, Range 1 East of W.M. Said portion further described as
follows;
Beginning on the existing centerline of said County Road at the Point Curvature Station 159 +83.09, as per the
map thereof entitled Lummi Shore Road — Lununi View Drive R.O.W. Plan, produced by Rich Carter, PLS
#32450 for the Lummi Nation Realignment of said County Road, near the North line of the South one half of the
South one half of G.L. 8 of said Section 2: Thence along the existing centerline of the portion of the road to be
vacated, southeasterly and northeasterly, approximately 3200 feet to a point on aforesaid centerline, 150 feet
Southwesterly of the new intersection of the realigned road as shown on said right of way improvement plans.
Said intersection being approximately 370 feet Southwesterly along the centerline from the North line of Section
11, Township 37 North, Range 1 East of W.M.. Less any portion to be dedicated to the new alignment.
Whatcom County, Washington
BE IT FURTHER RESOLVED that the County Engineer shall make a report of this portion of road and
shall file the same with the Whatcom County Council so that proceedings for the vacation of same can then be
carried on in the manner provided for in RCW 36.87.0 10 through RCW 36.87.080 and WCC 12.20.
