TO SELL COUNTY TAX TITLE PROPERTY
BY NEGOTIATION
REQUEST NO. 01 - 03
1 WHEREAS, RCW 36.35.120 allows the County to sell real estate acquired by
2 tax foreclosure where it is found to be in the best interest of Whatcom County to sell the
3 same; and,
4 WHEREAS, the Whatcom County Property Management Committee
s recommends the sale of the subject property by negotiation per RCW 36.35.150; and,
6 WHEREAS, RCW 36.35.120 requires the Council to establish the minimum price
7 for said unit of property; and,
s WHEREAS, the Whatcom County Code as well as the state law allows the
Q County to reserve from the sale coal, oil, gas, gravel, mineral, ores, fossils, timber or
io other resources if the Council finds that it is in the best interest to reserve these; and
Ii WHEREAS, the principal taxes, interest, penalty, title search and foreclosure
12 costs, total $1,047.40.
13 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the

27 By negotiation for no less than the minimum bid $1,047.40.
28 BE IT FURTHER RESOLVED that said price shall not be allowed under contract
29 and shall be paid in either cash, certified check, or money order to the Whatcom
3o County Treasurer at the time of sale; and,
31 BE IT FURTHER RESOLVED that said parcel shall be sold subject to restrictive
32 covenants allowing for imposition of Community Association fees, if any, as set forth in
33 Whatcom County Resolution No. 88 -37; and,
34 BE IT FURTHER RESOLVED that this sale transfer to the owners all coal, oil,
35 gas, gravel, minerals, ores, fossils, timber or other resources on or in said land and the
36 right to mine for and remove the same in conformity with zoning regulations in force and
37 effect; and,
38 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby
39 directed to sell such property at not less than a certified price and said sale shall take
40 place in accordance with the duties as established in RCW 36.35.120.

SUBJECT: Determination of Practicable to Build for Parcel APN 380519 458211
As requested I have researched parcel APN 380519 458211 to determine the extent practicable
to build.
Information was gathered on the subject parcel by research of current land use and natural
resources maps, aerial photographs and site visit performed on Friday, December 6, 2002.
Findings:
• The parcel is outside the Shoreline Management Program
• The parcel is located within frequently flooded areas under the Critical Areas Ordinance
• The parcel is bound on the north side by a regulated stream; steam buffer is 100' in width
• The parcel is identified as hydric soils under the Critical Areas Ordinance
• The parcel is zoned Agriculture
• The parcel is currently bordered by and may partially be utilized as an agriculture field
It is my conclusion that the subject parcel is not practicable to build based on the following:
• The entire parcel is located within a frequently flooded area
• The entire parcel is regulated by the buffer for the stream on the north side of the property
• The entire parcel shows wetland indictors on site t
