HEARING AND NOTICE OF HEARING ON
SALE OF COUNTY TAX TITLE PROPERTY
BY NEGOTIATION
REQUEST NO. 01 - 03
WHEREAS, the following described property is now, and has been the property of
the County of Whatcom, State of Washington since: as noted per parcel below and,
WHEREAS, the adjacent property owners were notified prior to tax foreclosu re sale
of the same date and no acceptable bids were received; and,
5 WHEREAS, the Whatcom County Property Management Committee determined the
6 lot is not practical to build because the entire parcel is located within a frequently flooded
7 area, the entire parcel is regulated by the buffer for the stream on the north side of the
8 property and the entire parcel shows wetland indictors on site and recommends the
9 property be sold by negotiation as per R.C.W. 36.35.150(2) for no less than the principal
10 taxes, interest, penalty, title search and foreclosure costs; and,
11 WHEREAS, The principal taxes, interest, penalty, title search and foreclosure costs
12 total $1,047.40; and,
13 WHEREAS, the Whatcom County Property Management Committee recommends
14 its sale by negotiation; and,
15 WHEREAS, the Whatcom County Council does deem it in the best interest of the
16 County and the people thereof that said property be sold for no less than the principal
17 taxes, interest, penalty, title search and foreclosure costs; and,

WHEREAS, Resolution 95 -005
designated
the Whatcom County Treasurer as

negotiator in such sales; and,
19 WHEREAS, RCW 36.35.120 requires the Council to establish the minimum pricefor
20 said units of property and to determine whether or not a contract will be allowed, or if it will
21 be a cash price;
22 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the County
23 to sell for a price to be negotiated by the Whatcom County Treasurer, the following Tax -

36 BE IT FURTHER RESOLVED by the Whatcom County Council, that a public hearing on
37 the matter of the sale of said property, under said terms, be held on
38 the 25 day of March 2003, at 7 p.m., at the Council Chambers
39 Whatcom County, Washington; and,
40 BE IT FURTHER RESOLVED that the Clerk of the Whatcom County Council shall
41 give notice of such hearing in the manner prescribed by law under RCW 36.34.030.

SUBJECT: Determination of Practicable to Build for Parcel APN 380519 458211
As requested I have researched parcel APN 380519 458211 to determine the extent practicable
to build.
Information was gathered on the subject parcel by research of current land use and natural
resources maps, aerial photographs and site visit performed on Friday, December 6, 2002.
Findings:
• The parcel is outside the Shoreline Management Program
• The parcel is located within frequently flooded areas under the Critical Areas Ordinance
• The parcel is bound on the north side by a regulated stream: steam buffer is 100' in width
• The parcel is identified as hydric soils under the Critical Areas Ordinance
• The parcel is zoned Agriculture
• The parcel is currently bordered by and may partially be utilized as an agriculture field
It is my conclusion that the subject parcel is not practicable to build based on the following:
• The entire parcel is located within a frequently flooded area
• The entire parcel is regulated by the buffer for the stream on the north side of the property
• The entire parcel shows wetland indictors on site
