' l:Ll(eial aauc SPONSORED BY: consent PROPOSED BY: Treasurer INTRODUCTION DATE: LLLLLQ3 RESOLUTION NO. 2003 -003 HEARING AND NOTICE OF HEARING ON SALE OF COUNTY TAX TITLE PROPERTY BY NEGOTIATION REQUEST NO. 05-02 WHEREAS, the following described property is now, and has been the property of the County of Whatcom, State of Washington since: as noted per parcel below and, WHEREAS, the adjacent property owners were notified prior to tax foreclosure sale of the same date and no acceptable bids were received; and, WHEREAS, the Whatcom County Property Management Committee determined the lot is not practical to build on because it is too small, recommends the property be sold by negotiation as per R.C.W. 36.35.150(2) for no less than the principal taxes, interest, penalty, title search and foreclosure costs; and, 9 WHEREAS, The principal taxes, interest, penalty, title search and foreclosure costs 10 total 378.99; and, 11 WHEREAS, the Whatcom County Council recommends its sale by negotiation; and, 12 WHEREAS, the Whatcom County Council does deem it in the best interest of the 13 County and the people thereof that said property be sold for no less than the principal 14 taxes, interest, penalty, title search and foreclosure costs; and, 15 WHEREAS, Resolution 95 -005 designated the Whatcom County Treasurer as 16 negotiator in such sales; and, 17 WHEREAS, RCW 36.35.120 requires the Council to establish the minimum price for 18 said units of property and to determine whether or not a contract will be allowed, or if it will 19 be a cash price; 20 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the County 21 to sell for a price to be negotiated by the Whatcom County Treasurer, the following Tax - 22 Title property acquired 2/26/1988 Tax foreclosure case #1579: 23 Parcel #405124.068353.0000 24 BIRCH BAY WEST END ESTATES -TR IN LOT 4 DAF -BEG AT NW CDR OF LOT 4- 25 TH E ALG N LI 39 FT -TH SWLY TO PT IN WILY LOT LI 30 FT SELY OF NW COR -TH 26 NWLY 30 FT ALG LOT LI TO POB -TOG WI UNDIVI /186 INT IN RESERVE A -TO 27 RECREATIONAL AREA SEC 24 TWN 40 RGE 1W 28 BE IT FURTHER RESOLVED by the Whatcom County Council, that a public 29 hearing on the matter of the sale of said property, under said terms, be held on 30 the 28 day of Jan. 2003, at 7 p.m., at the County Council Chambers 31 Whatcom County, Washington; and 32 BE IT FURTHER RESOLVED that the Clerk of the Whatcom County Council shall 33 give notice of such hearing in the manner prescribed by law under RCW 36.34.030. 34 APPROVED this 14 day of January 2003 35 36 ATTEST: 37 WASHINGTON - 38 �,. .. 39 Dana Brown- Davis, Council Clerk 40 APPROVED I�/� ' AS TO FORM: ` 41 l�r / I 11 42 Civil Deputy Prosecuting Attorney WHATCOM COUNTY COUNCIL WHATCOM COUNTY, Dan McShane, Chair
