RESOLUTION NO. 2004 -069
DECLARING THE POINT ROBERTS PUBLIC HOSPITAL DISTRICT
ELECTION AS VOTE -BY -MAIL ELECTION
WHEREAS, on October 21, 2004, the Whatcom County Council received a
petition asking for the formation of a Public Hospital District in Point Roberts; and
WHEREAS, attached to the petition was a certificate of sufficiency signed by the
Whatcom County Auditor certifying that the petition contained the signatures of at
least ten percent of the registered voters within the proposed district who voted at the
last general election; and
WHEREAS, in accordance with RCW 70.44.020 and 70.44.030, the Whatcom
County Council held a public hearing on the petition on November 23, 2004; and
WHEREAS, the Council found that the boundaries of the proposed district
established as the voting precinct of Point Roberts lying within Whatcom County as
currently defined by WCC 1.14.320 were appropriate, and
WHEREAS, at the conclusion of the public hearing the Council directed the
Whatcom County Auditor, by Resolution No. 2004 -061, to set an election for the
proposed Point Roberts Public Hospital District at the first available special election date
in 2005 held for such purpose, and in conjunction with that election to also submit to
the electorate within the proposed district the election of three district commissioners to
be elected at large from within the district in conformance with the requirements of
chapter 70.44 RCW, should the district be created at said election, and;
Whereas RCW 29A.48.020 authorizes the Whatcom County Auditor to conduct
such election by mail ballot when requested to do so.
NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that the
Whatcom County Auditor is requested to conduct the election ordered under Council
Resolution No._2004 -061 by mail ballot.
