It is the intent of the Board of Supervisors of the flood control zone district that the activities funded through the district and this subzone be continued for the next year, the district needs a continuing source of funding during that time. This resolution will extend the funding mechanism through 2005. Monson Sheriff Superior Court Related County Contract R: Treasurer Other Related File Numbers: Ordinance or Resolution Number ftltlshem): Resolution #2004 -063 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 SPONSORED BY: CONSENT PROPOSED BY: PUBLIC WORKS INTRODUCTION DATE: 11/09/D4 A Resolution by the Governing Body of the County-wide Flood Control Zone District hereinafter referred to as the Whatcom County Flood Control Zone District (WCFCZD) RESOLUTION NO. 2004 - ne3 AMENDING THE CURRENT WHATCOM COUNTY FLOOD CONTROL ZONE DISTRICT (WCFCZD) FUNDING MECHANISM AND LEVELS FOR THE LYNDEN /EVERSON SUBZONE WHEREAS, the WCFCZD was duly created by Whatcom County to provide a governmental entity and structure through which to address flooding and achieve flood damage reduction in Whatcom County; and, WHEREAS, the Lynden /Everson Subzone was established, in terms of governance structure, as traced thoroughly in the preamble to Ordinance 97 -049; and, WHEREAS, Ordinance 97 -054 established the funding mechanism for the Flood Control Zone District Subzones, amended by Resolution 99 -055 and Resolution 2002 -054 to extend the service charge through December 31, 2003; and, WHEREAS Resolution No. 2003 -074 provided for a funding mechanism through December 31, 2004; and, WHEREAS, since it is the intent of the Board of Supervisors of the flood control zone district that the activities funded through the Subzone be continued for the next year, the district needs a continuing source of funding during that time; and, WHEREAS, the use of assessments is a proper funding mechanism for Subzone activities; 1 NOW, THEREFORE, BE IT RESOLVED by the WCFCZD Board of 2 Supervisors that the funding mechanism for the Lynden /Everson Subzone, be as 3 follows: 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 Type of Parcel Unimproved, outside flood hazard area Improved, outside flood hazard area Unimproved, within flood hazard area Improved, within flood hazard area Sub -zone Fee $0.25 /acre $0.375 /acre $0.50 /acre Minimum Fee $5.00 /parcel $5.00 1parcel $5.00 /parcel $2.50 /acre Improved Minimum Value $25,000 - $49,999 = $30.00 /parcel $50,000 - $100,000 = $55.00 1parcel $100,001 - $300,000 = $75.00 /parcel greater than $300,000 = $200.00 /parcel Unimproved, part in and out of flood hazard area Prorated by area $5.00 /parcel $0.25 /acre out, and $0.50 /acre in Improved, part in Prorated by area Improved Minimum Value and out of flood hazard area $0.375 /acre out, and $25,000 - $49,999 = $30.00 1parcel $2.50 /acre in $50,000 - $100,000 = $55.00 /parcel $100,001 - $300,000 = $75.00 /parcel greater than $300,000 = $200.00 /parcel Fees for all parcels designated as "Open Space ", Classified Forest Land, Designated Forest Land and Non - commercial Forest and Forest Reserves will be reduced by 40 %. However, in no instance shall the reduction operate to reduce the amount owing below the $5.00 minimum per parcel. Flood hazard areas, for purposes of this resolution, are defined as those areas mapped as 100 -year floodplains or alluvial fans as shown on the latest maps produced by the Federal Emergency Management Agency and being used by the County for administering the Flood Damage Prevention Ordinance. BE IT FURTHER RESOLVED that the following parcels are exempt from paying fees to the Lynden /Everson Subzone: a. All parcels owned by the Federal Government, b. All parcels classified as Indian Lands held in trust, C. All parcels exclusively classified as mineral rights, d. All parcels owned by the State, classified as "bedlands or tidelands ", e. All parcels with assessed value less than or equal to $2,500. APPROVED this 23 day of November , 2004.
