RESOLUTION N0_2004-042
TO EXCHANGE COUNTY -OWNED PROPERTY AND A CASH PAYMENT
FOR CITY OF BELLINGHAM -OWNED PROPERTY
WHEREAS, Whatcom County is currently experiencing a serious problem with a
lack of jail space; and,
WHEREAS, the Whatcom County Council has recommended that the
Administration take the steps necessary to proceed with a plan to construct an interim
minimum security jail; and,
WHEREAS, RCW 36.34.005 allows the County to establish comprehensive
procedures for management of County property consistent with the public interest, and:
WHEREAS, Whatcom County has established comprehensive procedures for
disposition of County property under Whatcom County Code 1.10, and;
WHEREAS, the County desires to exchange property with, and purchase
property from the City of Bellingham for the purpose of constructing an interim minimum
security jail; and,
WHEREAS, the Whatcom County Property Management Committee
recommends, per Whatcom County Code 1.10.270, that certain property be transferred
for the purpose of exchanging it for City of Bellingham -owned land that better meets
County land needs; and,
WHEREAS, the City of Bellingham appears to be willing to sell the parcel of
property upon which the County is planning to locate an interim minimum security jail,
and to provide an easement over the adjacent lot for purposes of detention and
treatment of stormwater from the lot to be purchased by the County; and
WHEREAS, Whatcom County held a public hearing on this date to determine if it
is in the best interests of Whatcom County to exchange the property described below,
along with a cash payment of $587,500, to the City of Bellingham; and,
WHEREAS, after said hearing the Council does determine that it is in the best
interests of Whatcom County to transfer this property along with the cash payment to
the City of Bellingham so that it may be exchanged for City -owned property that better
meets the needs of the County,

NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the
County to transfer the properties listed below, along with a cash payment for $587,500,
in exchange for parcel #380317 389223 and an easement for stormwater detention and
treatment upon adjacent parcel #380317 413226, both owned by the City of
Bellingham, to better meet County land needs as per Whatcom County Code 1.10.270;

BE IT FURTHER RESOLVED that the County Executive is hereby authorized to
complete the exchange of these properties and the cash payment in the above - stated
amount to the City of Bellingham for fee simple interest in parcel #380317 389223 and
an easement for stormwater detention and treatment upon adjacent parcel #380317
413226, real property owned by the City of Bellingham.
