A RESOLUTION SUPPORTING WHATCOM COUNTY'S CONTRACTUAL RIGHTS IN THE
AGREEMENT BETWEEN WHATCOM COUNTY AND THE WASHINGTON STATE
DEPARTMENT OF NATURAL RESOURCES
WHEREAS, on June 9, 1992 the Whatcom County Council passed Resolution
# 92 -042 authorizing the Executive to execute an interagency agreement with the
Department of Natural Resources; and
WHEREAS, the Interagency Agreement between Whatcom County and the
DNR signed by Kenneth Eikenberry, Attorney General for the State of Washington,
and Shirley Van Zanten, Whatcom County Executive.
WHEREAS, the land exchange and agreement were approved of the Board of
Natural Resources; and
WHEREAS, Whatcom County, the Department of Natural Resources, the
Trillium Corporation, and Whatcom County Land Trust completed a land exchange
that included moving lands with the Lake Whatcom Watershed into public
ownership; and
WHEREAS, Whatcom County reimbursed the Department of Natural
Resources for actual costs of appraisals, and evaluations DNR staff and
administration incurred while preparing and closing the land exchange; and
WHEREAS, the Interagency Agreement between Whatcom County and the
Department of Natural Resources stated "Upon consummation of the exchange
agreement with Trillium Corporation, the County and DNR will initiate a joint
planning process to produce a formal forest management plan for public lands in
the Lake Whatcom Watershed. This formal management plan will accomplish
County and DNR goals, including but not limited to conservation of public resources,
water quality protection, reduction of risk and liability for both parties. This joint
planning process is understood by both parties to be a cooperative process which
will satisfy the objectives and legal requirements of each party "; and
WHEREAS, in Resolution 92 -042 Whatcom County agreed to fully participate
as an equal partner with the Department of Natural Resources in the development
and implementation of a formal forest management plan for the Lake Whatcom
Watershed; and
WHEREAS, Item #5 of the 1992 Interagency Agreement has not been
completed.
NOW, THEREFORE, BE IT RESOLVED that the Whatcom County Council
supports entering into mutually beneficial agreements between other local
governments and with State and Federal agencies;
BE IT FURTHER RESOLVED that the Whatcom County Council supports our
contractual right to Item 5 of the 1992 Interagency Agreement between Whatcom
County and the Washington State Department of Natural Resources approved by
the Board of Natural Resources in 1992 and respectfully requests the Board to take
action to fulfill its contractual obligation.
