A RESOLUTION SUPPORTING THE LAKE WHATCOM LANDSCAPE PLAN AS
RECOMMENDED BY THE LAKE WHATCOM LANDSCAPE PLANNING
COMMITTEE
WHEREAS, Lake Whatcom is the drinking water source for approximately
half the residents of Whatcom County; and
WHEREAS, the preservation and protection of drinking water is a top
priority of the Whatcom County Council; and
WHEREAS, the Whatcom County Natural Heritage Plan was endorsed by
the Whatcom County Council on July 2, 1991 (Resolution # 91 -044); and
WHEREAS, the Natural Heritage Task Force assessed the conservation
desires of County citizens and identified initial land conservation opportunities;
and
WHEREAS, the Natural Heritage Task Force determined that public
ownership of certain lands identified in the Natural Heritage Plan would be in the
public interest; and
WHEREAS, Whatcom County, the Department of Natural Resources, the
Trillium Corporation, and Whatcom County Land Trust identified lands suitable for
exchange to public ownership in order to meet certain goals of the Natural
Heritage Plan; and
WHEREAS, Whatcom County, the Department of Natural Resources, the
Trillium Corporation, and Whatcom County Land Trust completed the land
exchange that included moving lands with the Lake Whatcom Watershed into
public ownership; and

WHEREAS, Whatcom County reimbursed the Department of Natural
Resources for actual costs of appraisals, and evaluations DNR staff and
administration incurred while preparing and closing the land exchange for
portions of land on Chuckanut Mountain, the Lake Whatcom watershed and
certain frontage along the South Fork Nooksack River; and
WHEREAS, the land exchange was approved of the Board of Natural
Resources; and
WHEREAS, on June 9, 1992 the Whatcom County Council passed
Resolution # 92 -042 authorizing the Executive to execute an interagency
agreement with the Department of Natural Resources; and
WHEREAS, the Interagency Agreement between Whatcom County and the
Department of Natural Resources stated "Upon consummation of the exchange
agreement with Trillium Corporation, the County and DNR will initiate a joint
planning process to produce a formal forest management plan for public lands in
the Lake Whatcom Watershed. This formal management plan will accomplish
County and DNR goals, including but not limited to conservation of public
resources, water quality protection, reduction of risk and liability for both parties.
This joint planning process is understood by both parties to be a cooperative
process which will satisfy the objectives and legal requirements of each party ";
and
WHEREAS, in Resolution 92 -042 Whatcom County agreed to fully
participate as an equal partner with the Department of Natural Resources in the
development and implementation of a formal forest management plan for the
Lake Whatcom Watershed; and
WHEREAS, the Interagency Agreement between Whatcom County and the
DNR signed on June 12, 2002 by Kenneth Eikenberry, Attorney General for the
State of Washington, and Shirley Van Zanten, Whatcom County Executive.
WHEREAS, the 1992 Interagency Agreement has not been completed as
the as the formal management plan for public lands within the Lake Whatcom
Watershed has not been completed; and
WHEREAS, Legislature of Washington State enacted Engrossed Second
Substitute Senate Bill 6731 an act relating to Lake Whatcom that created the
Lake Whatcom landscape management pilot project; and
WHEREAS, Senate Bill 6731 directed the DNR to establish an
interjurisdictional committee for the development of the landscape plan; and
WHEREAS, Senate Bill 6731 stated that the landscape plan shall address
at least the following topics:

1) Establishing riparian management zones along all streams, as
classified under Chapter 4, Laws of 1999 sp. Sess. The department shall
manage lands within such zones to protect water quality and riparian
habitat. The interjurisdictional committee may recommend to the
department restrictions upon timber harvest and yarding activities on a
case by case basis;
2) Harvest and road construction upon potentially unstable slopes
shall be carefully regulated;
3) On unstable slopes, new road construction shall be prohibited and
old road reconstruction shall be limited;
4) A sustained yield model specific to the Lake Whatcom watershed
that encompasses the revised management standards and that is
consistent with the sustained yield established by the Board of Natural
Resources shall be created and implemented;
5) The department should build on the existing draft Lake Whatcom
landscape plan and incorporate both new information from the community
and new scientific information when available;
6) The development of a road management plan for the watershed.
WHEREAS, the interjurisdictional committee has worked in cooperation
with the Department of Natural Resources and has recommended a Lake
Whatcom Landscape Plan to the Board of Natural Resources; and
WHEREAS, the interjurisdictional committee and the Department of
Natural Resources reached consensus on all Lake Whatcom Landscape Plan
objectives and the strategies for accomplishing those objectives except the
following strategies:
1) Green tree retention. The Committee took no position.
2) Drilling beneath the watershed for oil or gas exploration. The Committee
opposed this activity.
3) The role of the Interjurisdictional Committee in reviewing proposed
activities within the watershed. The Committee recommended that the Lake
Whatcom Joint Management team enter into a memorandum of
understanding with the DNR so that certain types of activities on public land
in the watershed will fully comply with the Lake Whatcom Landscape Plan.
WHEREAS, the Whatcom County finds that the recommendations of the
Lake Whatcom Landscape Planning Committee to be an appropriate management
of forest lands within the Lake Whatcom Watershed for the protection of drinking
water quality in the lake, public safety and the generation of revenue for the
various trust beneficiaries;

NOW, THEREFORE, BE IT RESOLVED that the Whatcom County Council
supports the Lake Whatcom Landscape Plan as recommended by the Lake
Whatcom Landscape Planning Committee.
BE IT FURTHER RESOLVED that the Whatcom County Council will accept
the Lake Whatcom Landscape Plan as recommended by the Lake Whatcom
Landscape Planning Committee to satisfy the County and DNR joint planning
process and formal management plan for public lands within the Lake Whatcom
Watershed as final completion of the Interagency Agreement between Whatcom
County and the DNR approved in June 1992.
BE IT FURTHER RESOLVED that the Whatcom County Council will support
the Executive entering into a Memorandum of Agreement with the Department of
Natural Resources, the Lake Whatcom Water District and the City of Bellingham
for the creation of a technical interjurisdictional team to ensure that the Lake
Whatcom Management Plan is fully implemented.
BE IT FINALLY RESOLVED that the Whatcom County Council favors an
effective community process that will include the contribution of the Lake
Whatcom Forestry Advisory Forum.
