Bringing the WCC Chapter 3.28. 010 into context with the new Open
Space application and transfer fees as shown in the Unified Fee
Schedule.
The recommendation is to adopt the Ordinance.

REVISING WHATCOM COUNTY CODE 3.28.010, OPEN SPACE LAND CLASSIFICATION
PROCEDURE
WHEREAS, The proposal is exempt from the Slate Environmental Policy Act (SEPA)
Threshold Determination pursuant to a letter from the Deputy SEPA Official dated October 4, 2004;
and
WHEREAS, Members of staff of the Assessors and the Planning and Development
Services Department have historically worked together in the processing of all current use open
space classification applications; and
WHEREAS, Pursuant to RCW 84.34 and WAC 458 -30, the Assessor's Departmentand the
Planning and Development Services Department can establish application fees commensurate to
the time involved in processing all current use open space applications; and
WHEREAS, It is in the best interests of Whatcom County to refer to the Unified Fee
Schedule; and
WHEREAS, It is appropriate to review the fees set for each current years' Unified Fee
Schedule; and
WHEREAS, the Whatcom County Council finds the amendment to be within the interest of
the public health, safety and welfare; and
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that Whatcom County
Code 3.28.010 is hereby revised as indicated in Exhibit A to this Ordinance.

EXHIBIT "A" TO ORDINANCE 2004-
Revisions to the Open Space Procedure
3.28.010 Application fee.
Pursuant to the open space law, Chapter 84.34 RCW, and Chapter 458-
30 WAC, an application fee of $3999 is established as the rued n
seaneotiee according to the Unified Fee Schedule with each separate
application or transfer for current use classification under the state's open
space law. All open space application fees together with the applicant's
deposit to cover the auditor's filing fee shall be placed in the Whatcom
County treasurer's suspense fund; and if the application is denied, the
Whatcom County treasurer is authorized to disburse the application fee
and fling fee into the Whatcom County current expense fund; however, if
the application is approved, the auditor is to be reimbursed for recording of
the approved application, and the remainder of the filing fee and the
application fee is to be transferred into the Whatcom County current
