SUMMARY STATEMENT; Amending the Whatcom County Comprehensive Plan, Urban Fringe Subarea Plan Map 13 map and text to create a new Area 2 of approximately 75 acres and to designate the new Area 2 as °Provisional Rezone to URM -24" under specific circumstances. Note: The subject proposal is one of a number of comprehensive plan amendments initiated this year. These amendments must be considered concurrently by the County Council so that the cumulative effect of the various proposals can be evaluated (RCW 36.70A.130). The Council makes the following findings of fact and conclusions: FINDINGS OF FACT 1. Notice of the Planning Commission hearing for the subject amendments was published in the Bellingham Herald on October 30, 2003. 2. The City of Bellingham and Whatcom County Planning Commissions held a joint public hearing on the subject amendments on November 13, 2003 and a work session'on November 20,2003. 1:\2 Planning Divisien\Comp Plan Amendments \Comp Plan 2003 \CMP2003 40003 (Urban Fringe Subarea - Map 13) - Draft ORD 12-34n doc P. I 3. A determination of non - significance (DNS) was issued on November 11, 2003, under the State Environmental Policy Act (SEPA). 4. Population and land supply studies conducted by the City of Bellingham and Whatcom County indicate a shortage of residential capacity within the City of Bellingham and Urban Growth Area to meet the projected demand for housing. 5. The proposed amendments will facilitate increased density within portions of the existing Bellingham Urban Growth Area where public services and utilities are available. 6. The proposed amendments will provide additional incentive to encourage the transfer of development rights from the Lake Whatcom Watershed to the City of Bellingham's Urban Growth Area. CONCLUSIONS The subject amendments are consistent with the Growth Management Act, County Wide Planning Policies, and the Whatcom County Comprehensive Plan. 2. The subject amendments are based upon further study and evaluation of the projected population growth in Whatcom County and available land supply within the City of Bellingham Urban Growth Area. Therefore, the proposed amendments are consistent with the RCW 36.70.410, which requires that Comprehensive Plan amendments must be based upon further study or changed conditions. 3. The subject amendments comply with the approval criteria for comprehensive plan amendments of WCC 20.10.080. NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that: Section 1. The Whatcom County Comprehensive Plan, Urban Fringe Subarea Plan Map 13 map and text are hereby amended as shown on Exhibit A, Map and Exhibit B, text. Section 2. Adjudication of invalidity of any of the sections, clauses, or provisions of this ordinance shall not affect or impair the validity of the ordinance as a whole or any part thereof other than the part so declared to be invalid. King and Queen Mountains lying, north of East Bakerview Road, form the visual backdrop for the area. The area comprises approximately 343 acres currently zoned Urban Residential Mixed Use (URMX), . The terrain is generally flat to gentle and severe hummock and Swale, and slopes in a southwesterly direction. BalkerGPee area. This area has pastures, some dense forest cover, and wetlands to the south of Telegraph Road and along the Baker Creek corridor. Roads serving the area include East Bakerview, Telegraph, and James Street Road. East Bakerview Road is an arterial and major truck route linking the Hannegan industrial area with Guide Meridian and Interstate -5. James Street Road is a collector linking East Bakerview and the King and Queen Mountain residential areas with Sunset Square shopping center and Interstate -5. Telegraph Road and James Street link the regional commercial area at Bellis Fair with Sunset Square and Mount Baker Highway. Whatcom Transit Authority has plans to increase service to this Area as residential development increases. Fire and police services are provided by Whatcom County Fire District #4 and the Sheriffs Department. The Telegraph Water Association and Water District #9 serving parts of this area and the King Mountain area to the north were assumed by the City of Bellingham in 1992.
