RESOLUTION NO. 2005 -060
HEARING AND NOTICE OF HEARING ON
SALE OF COUNTY TAX TITLE PROPERTY
REQUEST NO. 2005 -06
i WHEREAS, the following described properties are now, and have been the
2 property of the County of Whatcom, State of Washington as noted per parcel
3 information below and,
4 WHEREAS, the Whatcom County Council does deem it in the best interest of
5 the County and the people thereof that said properties be conveyed to the City of
6 Bellingham; and,
7 WHEREAS, the Whatcom County Property Management Committee
8 recommends the disposal of the subject property by conveyance of a deed to the City
9 of Bellingham to effectively meet the legal requirement for disposal;
10 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the
11 County to convey by quit claim deed to the City of Bellingham:

13 W 30 FT of SW NE NE — EXC N 490 FT THEREOF - Situate in Section 17, Township
14 38, Range 3 East W.M.
15 Parcel # 380317- 263531 -0000

18 For an amount of $0.00 in view of the absence of a market value for land lying
19 underneath city streets, the dedication of which to the City of Bellingham was a
20 condition of annexation when this area was annexed into the City of Bellingham. The
21 legal propriety of this disposition in light of RCW 36.35.150 has been discussed with
22 the State Auditor's local examiner, who concurs with this conclusion in consideration of
23 the circumstances.

25 BE IT FURTHER RESOLVED by the Whatcom County Council, that a public
26 hearing on the matter of the disposal of said property, under said terms, be held on the
27 9thday of November 2005, at 7:00 p.m., at the Courthouse Whatcom
28 County, Washington; and,
29 BE IT FURTHER RESOLVED that the Clerk of the Whatcom County Council
30 shall give notice of such hearing in the manner prescribed by law under RCW
31 36.34.030.
