RESOLUTION NO. 2005 -055
TO SELL COUNTY TAX TITLE PROPERTY
BY NEGOTIATION
REQUEST NO. 2005 -02
1 WHEREAS, RCW 36.35.120 allows the County to sell real estate acquired by
2 tax foreclosure where it is found to be in the best interest of Whatcom County to sell the
3 same; and,
4 WHEREAS, the Whatcom County Property Management Committee
5 recommends the sale of the subject property by negotiation per RCW 36.35.150 (2) for
6 no less than the principal taxes, interest, penalty, title search and foreclosure costs;
7 and,
s WHEREAS, RCW 36.35.120 requires the Council to establish the minimum price
9 for said unit of property; and,
10 WHEREAS, the Whatcom County Code as well as the state law allows the
ii County to reserve from the sale coal, oil, gas, gravel, mineral, ores, fossils, timber or
12 other resources if the Council finds that it is in the best interest to reserve these; and
13 WHEREAS, the principal taxes, interest, penalty, title search and foreclosure
14 costs, total 65.59.
15 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the
16 County to sell:

18 By negotiation for no less than the minimum bid $465.59

19 BE IT FURTHER RESOLVED that said price shall not be allowed under contract
20 and shall be paid in either cash, certified check, or money order to the Whatcom
21 County Treasurer at the time of sale; and,
22 BE IT FURTHER RESOLVED that said parcel shall be sold subject to restrictive
23 covenants allowing for imposition of Community Association fees, if any, as set forth in
24 Whatcom County Resolution No. 88 -37; and,
25 BE IT FURTHER RESOLVED that this sale transfer to the owners all coal, oil,
26 gas, gravel, minerals, ores, fossils, timber or other resources on or in said land and the
27 right to mine for and remove the same in conformity with zoning regulations in force and
28 effect; and,
29 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby
3o directed to sell such property at not less than a certified price and said sale shall take
31 place in accordance with the duties as established in RCW 36.35.120.
