SUMMARY STATEMENT. The Property Management Committee recommends that the resolution be passed for the sale of tax title
property by negotiation to Whatcom County Public Works:
Parcel No. 390124 353246 0000
The north 20 feet of the west 660 feet of the north 330 feet of the Southeast quarter and the west 30 feet of the east 40 feet of the north
330 feet of the west 660 feet of the Northwest quarter of the Southeast quarter all in Section 24, Township 39 North, Range 1 East of
W.M., except any portion thereof granted to Whatcom County for road, AF 1572296-298.
Situate in County of Whatcom, State of Washington
Property Location: North of Storr Road and West of Church Road, Femdale, WA.
The principal taxes, Interest, penalty, title search and foreclosure costs total $300.00.

RESOLUTION NO. 2005 -044
TO SELL COUNTY TAX TITLE PROPERTY
BY NEGOTIATION
REQUEST NO. 01 -05
I WHEREAS, RCW 36.35.120 allows the County to sell real estate acquired by
2 tax foreclosure where it is found to be in the best interest of Whatcom County to sell the
3 same; and,
4 WHEREAS, the Whatcom County Property Management Committee
s recommends the sale of the subject property by negotiation to Whatcom County Public
6 Works per RCW 36.35.150 (2) for no less than the principal taxes, interest, penalty, title
7 search and foreclosure costs; and,
s `.WHEREAS, RCW 36.35.120 requires the Council to establish the minimum price
9 for said unit of property; and,
10 WHEREAS, the Whatcom County Code as well as the state law allows the
i i County to reserve from the sale coal, oil, gas, gravel, mineral, ores, fossils, timber or
12 other resources if the Council finds that it is in the best interest to reserve these; and
13 WHEREAS, the principal taxes, interest, penalty, title search and foreclosure
14 costs, total $300.00.
15 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the
16 County to sell:

3o By negotiation for no less than the minimum bid $300.00
31 BE IT FURTHER RESOLVED that said price shall not be allowed under contract
32 and shall be paid by InterFund transfer to the Whatcom County Treasurer at the time of
33 sale; and,
34 BE IT FURTHER RESOLVED that said parcel shall be sold subject to restrictive
35 covenants allowing for imposition of Community Association fees, if any, as set forth in
36 Whatcom County Resolution No. 88 -37; and,
37 BE IT FURTHER RESOLVED that this sale transfer to the owners all coal, oil,
38 gas, gravel, minerals, ores, fossils, timber or other resources on or in said land and the
39 right to mine for and remove the same in conformity with zoning regulations in force and
4o effect; and,
41 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby
42 directed to sell such property at not less than a certified price and said sale shall take
43 place in accordance with the duties as established in RCW 36.35.120 and RCW
44 36.35.150.
