Tile attached Resolution Vacating a Portion of Mosquito Lake Road pertains to that portion of the former
road alignment that was destroyed by encroachment of the Middle Fork of the Nooksack River during
2003-2004. On May 24, 2005 Resolution Number 2005-022 was presented to the County Council and
subsequently approved declaring the intention to this portion of Mosquito Lake Road. The attached Report
of the County Engineer was petitioned by said resolution.
Public Works recommends adoption of this resolution.

IN THE MATTER OF THE VACATION of a portion of Mosquito Lake Road, filed by
Whatcom County Public Works, Engineering Division the Whatcom County Council
finds as follows:
WHEREAS, the Whatcom County Council did, on August 9, 2005, order the
vacation of a portion of Mosquito Lake Road, petitioned by Whatcom County Public
Works, Engineering Division; and
NOW, THEREFORE, THE WHATCOM COUNTY COUNCIL ORDERS that the
road(s) or portion(s) thereof, described below, be vacated:

A RESOLUTION VACATING A PORTION OF MOSQUITO LAKE ROAD
WHEREAS, on May 24, 2005 Resolution Number 2005 -022 was presented to the County Council
and subsequently approved declaring the intention to vacate approximately 1900 linear feet of Mosquito Lake
Road, and
WHEREAS, the County Engineer's office has reviewed the portion of the county road proposed to be
vacated which is Class A -116 right of way, wherein public expenditures were made, no part of which lies within
any platted subdivision and has been abandoned in fact due to relocation of the right of way, and the public
would benefit from said vacation, and
WHEREAS, in November of 2004, Whatcom County Public Works completed construction of a
realigned section of Mosquito Lake Road, and
WHEREAS, the originally established right -of -way of Mosquito Lake Road was compromised by
continued encroachment by the Middle Fork of the Nooksack River, and
NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that the below described
right -of -way be hereby vacated, and as shown on Exhibit "A ":
A portion of County Road #192 -306 AKA Mosquito Lake Road lying in the SW Quarter of the SW
Quarter of Section 12 and Government Trot 11 and the NE Quarter of the SE Quarter of Section 11,
Township 38 North, Range 5 East of W.M. Said portion further described as follows:
Conunencing at the section corner common to sections 11/12/14/13 in Township 38 North, Range 5
East of W.M.; thence easterly along the south line of Section 12 S 88 °24'4$" E, 599.22 feet to its
intersection with the centerline of Mosquito Lake Road; thence northerly along the centerline of
Mosquito Lake Road N 15 °06'03" E, 235.04 feet to the TRUE POINT OF BEGINNING; thence
northerly along the centerline of Mosquito Lake Road as it existed on January 1, 2004 a distance of
1908 feet more air less to a line perpendicular to the road centerline drawn through the two most
northerly property corner rebarlcaps set for Right of Way Application No. 50- 076111 and the map
thereof under Whatcom County Auditor's File No. 2040602221 near the southerly bank of Porter
Creek. Less any portion dedicated to the new right of way on Application No. 50-076111 and the
map thereof under Whatcom County Auditor's File No. 2040602221.
