The attached Resolution Declaring Intent to Vacate a Portion of Mosquito Lake Road pertains to that portion of the former road alignment that we destroyed by encroachment of the Middle Fork of the Nooksack River during 2003 -2004. Public Works recommends adoption of this resolution. Adoption will trigger the County Engineer to report on the proposed vacation at a future Council meeting. once the County Engineer's report is submitted, a public hearing will be scheduled, and actual road vacation will be considered by Council under a separate resolution. SPONSORED BY: Public Works NtS�>.Y ID : 8 1. . 0 , - - INTRODUCTION DATE: 5/10/2005_ RESOLUTION NO. 2005 -022 A RESOLUTION DECLARING INTENT TO VACATE A PORTION OF MOSQUITO LAKE ROAD WHEREAS, in November of 2004, Whatcom County Public Works completed construction of a realigned section of Mosquito Lake Road, and WHEREAS, the originally established right -of -way of Mosquito Lake Road was compromised by continued encroachment by the Middle Fork of the Nooksack River, and WHEREAS, the Washington Department of Natural Resources required the county to initiate proceedings to vacate the old portion of Mosquito Lake Road as one of the conditions of Easement No. 50- 076111 (Exhibit D), and WHEREAS, as described in RCW 36.87.010, when a county road or any part thereof is considered useless, the Whatcom County Council may declare its intention to formally consider vacation, by resolution. NOW, THEREFORE, BE IT RESOLVED that it is the intention of the Whatcom County Council to consider vacation of the following described right-of-way, as shown on Exhibit "A 25 A portion of County Road #192 -306 AKA Mosquito Lake Road lying in the SW Quarter of the SW 26 Quarter of Section 12 and Government Lot 11 and the NE Quarter of the SE Quarter of Section 11, 27 Township 38 North, Range 5 East of W.M. Said portion further described as follows: Commencing at the section comer common to sections 11/11,14/13 in Township 38 North, Range 5 East of W.M.; thence easterly along the south line of Section 12 S 88 024'48" E, 599.22 feet to its intersection with the centerline of Mosquito Lake Road; thence northerly along the centerline of Mosquito Lake Road N 15 °06'03" E, 235.04 feet to the TRUE POINT OF BEGINNING; thence northerly along the centerline of Mosquito Lake Road as it existed on January 1, 2004 a distance of' 1908 feet more or less to a line perpendicular to the road centerline drawn through the two most northerly property comer rebadcaps set for Right of Way Application No. 50-076111 and the map thereof under Whatcom County Auditor's File No. 2040602221 near the southerly bank of Porter Creek. Less any portion dedicated to the new right of way on Application No. 50-076111 and the map thereof under Whatcom County Auditor's File No. 2040602221. BE IT FURTHER RESOLVED that the County Engineer shall make a report on this portion of road and shall file the same with the Whatcom County Council so that proceedings for the vacation of same can then be carried on in the manner provided for in RCW 36.87.010 through RCW 36.87.080 and WCC 12.20.
