It is the intent of the Board of Supervisors of the flood control zone district that the activities funded
through the district and this Subzone be continued for the next year, as the district needs a continuing
source of funding during that time.
This resolution will extend the funding mechanism through 2007.

9 Flood Control Zone District (WCFCZD)

14 AMENDING THE CURRENT WHATCOM COUNTY
15 FLOOD CONTROL ZONE DISTRICT (WCFCZD)
16 FUNDING MECHANISM AND LEVELS FOR THE
17 LYNDEN /EVERSON SUBZONE

20 WHEREAS, the WCFCZD was duly created by Whatcom County to provide
21 a governmental entity and structure through which to address flooding and achieve
22 flood damage reduction in Whatcom County; and,
23
24 WHEREAS, the Lynden /Everson Subzone was established, in terms of
25 governance structure, as set forth thoroughly in the preamble to Ordinance 97-
26 049; and,
27
28 WHEREAS Resolution No. 2005 -073 provided for a funding mechanism
29 through December 31, 2006 and is now expiring; and,

31 WHEREAS, since it is the intent of the Board of Supervisors of the flood
32 control zone district that the activities funded through the Subzone be continued
33 for the next year, the district needs a continuing source of funding during that time;
34 and,

36 WHEREAS, the use of assessments is a proper funding mechanism for
37 Subzone activities;

39 NOW, THEREFORE, BE IT RESOLVED by the WCFCZD Board of
40 Supervisors that the funding mechanism for the Lynden /Everson Subzone, be as

*If the improvement can be shown to be located entirely outside of the flood hazard
area, the rate applied to the acreage within the flood hazard area can be reduced to the
unimproved rate of $0.50/acre in the flood hazard area.
For purposes of this resolution, the term "parcel" is defined to include auxiliary
residential units, such as condominiums and mobile homes when they are not included
in the parent land parcel.
Fees for all parcels designated as "Open Space ", Classified Forest Land, Designated
Forest Land and Non - commercial Forest and Forest Reserves will be reduced by 40 %.
However, in no instance shall the reduction operate to reduce the amount owing below
the $5.00 minimum per parcel.
Flood hazard areas, for purposes of this resolution, are defined as those areas mapped
as 100 -year floodplains or alluvial fans as shown on the latest maps produced by the
Federal Emergency Management Agency and being used by the County for
administering the Flood Damage Prevention Ordinance.
BE IT FURTHER RESOLVED that the following parcels are exempt from paying
fees to the LyndenlEverson Subzone:
a. All parcels owned by the Federal Government,

b. All parcels classified as Indian Lands held in trust,
C. All parcels exclusively classified as mineral rights,
d. All parcels owned by the State, classified as "bedlands or
tidelands",
e. All parcels with assessed value less than or equal to $2,500.
