TR2006 -13 1 WHEREAS, the following described property is now, and has been the property of 2 the County of Whatcom, State of Washington since: as noted per parcel below; and, 3 WHEREAS, The Whatcom County Property Management Committee determined 4 that it is not practical to build on the property and recommends the resolution be passed to 5 effectively meet the legal requirement for the disposal by negotiation per RCW 6 36.35.150(2); and, 7 WHEREAS, the Whatcom County Property Management Committee recommends 8 its sale by negotiation; and, 9 WHEREAS, the Whatcom County Property Management Committee recommends 10 the Whatcom County Treasurer enter into negotiations with the adjacent property owners 11 as well as the applicant; and, 12 WHEREAS, The principal taxes, interest, penalties, title search and foreclosure 13 costs total 906.90• and, 14 WHEREAS, the Whatcom County Council does deem it in the best interest of the 15 County and the people thereof that said property be sold for no less than the principal 16 taxes, interest, penalties, title search and foreclosure costs; and, 17 WHEREAS, Resolution 95 -005 designated the Whatcom County Treasurer as 18 negotiator in such sales; and, 19 WHEREAS, RCW 36.35.120 requires the Council to establish the minimum price for 20 said units of property and to determine whether or not a contract will be allowed, or if it will 21 be a cash price; 22 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the County 23 to sell for a price to be negotiated by the Whatcom County Treasurer, the following Tax - 24 Title property acquired 1212911989, 25 Parcel No. 400527 - 227415 -0000 26 THAT PTN OF N 112 NE SE NW LY WLY OF WLY LI OF ABANDONED RR R[W -EXC 27 THAT PTN OF FOL LY WITHIN E 112 SE NW -THAT PTN OF E 112 SE NE -E 112 NE 28 NW DAF -BEG AT NW COR OF E 112 SE NW -TH N 42 DEG 41'27" E 480.90 FT -TH S 29 20 DEG 40'21" E 712.10 FT TO CURVE TO RIGHT HAVING RADIUS OF 1210 FT 30 CTR WH BEARS S 69 DEG 19'39" W= fH ALG SD CURVE THRU CIA OF 00 DEG 31 23'11" ARC DISTANCE OF 8.16 FT TO S LI N 112 N 112 E 112 SE NW -TH S 89 DEG 32 04'10" W ALG SD S LI 570.76 FT TO WLY LI OF E 112 -TH N 01 DEG 40'22" W ALG 33 SD WLY LI 329.83 FT TO POB 34 BE IT FURTHER RESOLVED by the Whatcom County Council, that a public 35 hearing on the matter of the sale of said property, under said terms, be held on 36 the 24th day of October 2006, at 7:oo p.m., at the What-rnm rn„nty rn„rtHn „cA , 37 Whatcom County, Washington; and, 38 39 .1 41 42 43 44 45 BE IT FURTHER RESOLVED that the Clerk of the Whatcom County Council shall give notice of such hearing in the manner prescribed by law under RCW 36.34.030.
