SPONSORED BY: Consent PROPOSED BY: Treasurer INTRODUCTION DATE: 10/10/2006 RESOLUTION NO ?006 -059 TO SET HEARING AND NOTICE OF HEARING OF THE SALE OF COUNTY TAX TITLE PROPERTY BY NEGOTIATION REQUEST NO. TR2006 -12 1 WHEREAS, the following described property is now, and has been the property of 2 the County of Whatcom, State of Washington since: as noted per parcel below; and, 3 WHEREAS, The Whatcom County Property Management Committee determined 4 that it is not practical to build on the property and recommends the resolution be passed to 5 effectively meet the legal requirement for the disposal by negotiation per RCW 6 36.35.150(2); and, 7 WHEREAS, the Whatcom County Property Management Committee recommends 8 its sale by negotiation; and, 9 WHEREAS, the Whatcom County Property Management Committee recommends 10 the Whatcom County Treasurer enter into negotiations with the adjacent property owners 11 as well as the applicant; and, 12 WHEREAS, The principal taxes, interest, penalties, title search and foreclosure 13 costs total $2,787.85 and, 14 WHEREAS, the Whatcom County Council does deem it in the best interest of the 15 County and the people thereof that said property be sold for no less than the principal 16 taxes, interest, penalties, title search and foreclosure costs; and, 17 WHEREAS, Resolution 95 -005 designated the Whatcom County Treasurer as 18 negotiator in such sales; and, 19 WHEREAS, RCW 36.35.120 requires the Council to establish the minimum price for 20 said units of property and to determine whether or not a contract will be allowed, or if it will 21 be a cash price; 22 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the County 23 to sell for a price to be negotiated by the Whatcom County Treasurer, the following Tax - 24 Title property acquired 1112212002, 25 Parcel No. 370224 - 502373 -0000 26 THAT PTN OF LOT D -13114 LLA TO LOTS 10 -11 -12 BRIGHTON CREST -LOT 2 BUGGIA 27 SHORT PLAT AS REC BOOK 35 SHORT PLATS PG 88 LY WITHIN TR FKA LOT 2 28 BUGGIA SHORT PLAT AS REC BOOK 21 SHORT PLATS PG 67 29 BE IT FURTHER RESOLVED by the Whatcom County Council, that a public 30 hearing on the matter of the sale of said property, under said terms, be held on 31 the 24tltAay of October 2006, at 7:00 p.m., at the Whatcom county courthouse , 32 Whatcom County, Washington; and, 33 BE IT FURTHER RESOLVED that the Clerk of the Whatcom County Council shall 34 give notice of such hearing in the manner prescribed by law under RCW 36.34.030. 35 APPROVED this loth day of October 2006 36 37 38 39 40 Y C p WHATC, � v AMSI�NIIKY �� :� '= 41 APPROVED AS TO FORM: 42 -- 43 Civil tecuting Attorney WHATCOM COUNTY COUNCIL WHATCOM COUNTY, J.'
