NOTICE OF HEARING OF THE
SALE OF COUNTY TAX TITLE PROPERTY
BY NEGOTIATION
REQUEST NO. TR2006 -04

WHEREAS, the following described property is
now, and has been
the property of

the County of Whatcom,
State of Washington
since:

and,
3 WHEREAS, the adjacent property owners were notified prior to tax foreclosure sale
4 of the same date and no acceptable bids were received; and,
5 WHEREAS, the Whatcom County Property Management Committee recommends
6 that the resolution be passed to effectively meet the legal requirement for the disposal by
7 negotiation per RCW 36.35.150(1); when the sale is to any governmental agency and for
8 public purposes; for no less than the principal taxes, interest, penalties, title search and
9 foreclosure costs of $3140.53,

THAT PORTION OF GOVERNMENT LOT 13 LYING SOUTHWESTERLY OF
SMUGGLER'S SLOUGH SECTION 07 TOWNSHIP 38 RANGE 2E
11 and,
12 WHEREAS, The principal taxes, interest, penalties, title search and foreclosure
13 costs total $3140.53 and,
16 WHEREAS, the Whatcom County Property Management Committee recommends
17 its sale by negotiation; and,
18 WHEREAS, the Whatcom County Council does deem it in the best interest of the
19 County and the people thereof that said property be sold for no less than the principal
20 taxes, interest, penalties, title search and foreclosure costs; and,
21 WHEREAS, Resolution 95 -005 designated the Whatcom County Treasurer as
22 negotiator in such sales; and,
23 WHEREAS, RCW 36.35.120 requires the Council to establish the minimum price for
24 said units of property and to determine whether or not a contract will be allowed, or if it will
25 be a cash price;
26 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the County
27 to sell for a price to be negotiated by the Whatcom County Treasurer, the following Tax -

30 THAT PORTION OF GOVERNMENT LOT 13 LYING SOUTHWESTERLY OF
31 SMUGGLER'S SLOUGH SECTION 07 TOWNSHIP 38 RANGE 2E
32 BE IT FURTHER RESOLVED by the Whatcom County Council, that a public
33 hearing on the matter of the sale of said property, under said terms, be held on
34 the .14 day of March, 2006, at 7:00 p.m.,atthe Courthouse
35 Whatcom County, Washington; and,
36 BE IT FURTHER RESOLVED that the Clerk of the Whatcom County Council shall
37 give notice of such hearing in the manner prescribed by law under RCW 36.34.030.
