Whatcom County seeks by resolution, to accept a portion of a proposed newly constructed road, on Delta
Line Road from 400 feet north of Grandview Road and including all of the roadway curving west and
accessing Vista Drive. This new portion is to be known as Delta Line Road. The County offers the
following pertinent facts to support the establishment;
The existing access to Delta Line Road off Grandview Road does not meet the required minimum sight
distance and minimum turning radius. The new realignment of Delta Line Road allows for a safe access
meeting sight distance and safe turning radius requirements. The 400 -foot leg of Delta Line Road
between the new portion and Grandview Road will be closed after the approval, acceptance, and opening
of the newly constructed portion. The County Council approved the closure of the 400 -foot leg between
the new portion and Grandview Road on 2124104, Whatcom County requests County Council accepts
and adopts the road, right -of -way, and drainage easements upon acceptance of the construction
improvements by Whatcom County Public Works, and completion of the right -of -way acquisition.

DECLARING INTENT TO ACCEPT A NEW SECTION OF DELTA LINE ROAD,
DECLARING THAT SUCH ESTABLISHMENT IS A PUBLIC AND SAFETY NECESSITY, AND
DIRECTING COUNTY ROAD ENGINEER TO REPORT TO COUNCIL UPON THE PROJECT
WHEREAS, the Whatcom County Council has previously approved the closure of the
portion of Delta Line Road from SR 548 to 0.13 miles north of SR548 on 2124104, contingent
upon the acceptance of the new Delta Line Road alignment, Ordinance #2044 -008, Adopted 7-
0; and
WHEREAS, the new intersection of the connector constructed between Delta Line Road
and Vista Drive meets the minimum sight distance and necessary turning radius; and
WHEREAS, the new connecting road provides necessary and safe vehicular access to a
significant number of potential business sites; and
WHEREAS, Ferrotech Incorporated has constructed the roadway within right -of -way that
is being acquired by the County, said right -of -way connecting that northern portion of Delta Line
Road lying south of 1 -5 to Vista Drive; and
WHEREAS, the County is presently in the process of acquiring, as public right -of -way,
from the landowner the portion of his property upon which the new road has been constructed;
and
WHEREAS, it is a matter of general policy for the County to establish a County road and
assume responsibility for its maintenance, if doing so provides service to the citizenry at a
reasonable cost; and
WHEREAS, the public will be better served by county maintenance of the road identified
herein; and
WHEREAS, the financial burden assumed by the County as a result of increased road
maintenance responsibilities is balanced by increased revenues from state tax funds for the
additional length of road in the County road system; and
WHEREAS, the Council needs the most accurate, up -to -date information concerning the
condition of the roadway, the status of the underlying right -of -way, the financial implications of
accepting this roadway into the County road system, and the public benefit to be derived from
the establishment of this roadway as a County road; and
WHEREAS, RCW 36.81 requires that the County Road Engineer, upon direction from
the Council, provide such information to the Council via a report; and
