Due to a recent Internal Revenue Service (IRS) determination, the County's existing agreement with the ICMA Relirement
Corporation ( "ICMA -RC ") originally set -Lip through County Ordinance Number 2002 -039 requires amendment for 2005.
The proposed Amendment to the RHS Adoption Agreement will bring the plan into compliance with new guidance From
the Internal Revenue Service by:
1. Making the R 4S Plan mandatory for all employees who accrue over 960 hours of sick leave.
2. - Providing for the reversion of account balances to the County if a participant dies with no living spouse or
dependents.

RESOLUTION NO. 2007-072
AMENDMENT TO WHATCOM COUNTY VANTAGECARE
RETIREMENT HEALTH SAVINGS (RHS) PLAN
Plan Number 800206
WHEREAS, Whatcom County (the "County") has employees rendering valuable services; and
WHEREAS, Whatcom County has established a retiree health savings plan in the form of the
VantageCare Retirement Health Savings Plan (the "Plan ") for such employees that serves the interest of
the Employer by enabling it to provide reasonable security regarding such employees' health needs during
retirement, by providing increased flexibility in its personnel management system, and by assisting in the
attraction and retention of competent personnel; and
WHEREAS, the County has determined that the continuance of the Plan serves the above
objectives;
NOW, THEREFORE BE IT RESOLVED by the Whatcom County Council that the County hereby
amends and restates the Plan as outlined in the attached Adoption Agreement amending the VantageCare
Retirement Health Savings Plan.
