TITLE OF DOCUMENT: A Resolution by the Governing Body of the County -Wide Flood Control Zone
District (WCFCZD) extending the current WCFCZD funding mechanism and levels for the Samish
Watershed Subzone.

It is the intent of the Board of Supervisors of the Flood Control Zone District that the activities funded through
the District and this Subzone be continued for the next year, as the District needs a continuing source of
funding during that time.
This resolution will extend the funding mechanism through 2008.

A Resolution by the Governing Body of the
County wide Flood Control Zone District
hereinafter referred to as the Whatcom County
Flood Control Zone District (WCFCZD)
RESOLUTION NO. 2007- 068
SETTING A TEN -YEAR TERM FOR THE ASSESSMENT TO PROVIDE
REVENUE FOR THE SAMISH WATERSHED SUBZONE
WHEREAS, RCW 86.15.160 (2) authorizes an assessment upon property,
including state property, specially benefited by flood control improvements or
storm water control improvements; and,
WHEREAS, in accordance with RCW 86.15.025 on June 20`h, 2006, a
geographic portion of the Whatcom County Flood Control Zone District was
established as the Samish Watershed Subzone; and,
WHEREAS, the Samish Lake Management District No. 1 Advisory
Committee had recommended an assessment to fund maintenance and operation
of the Friday Creek dam and removal of debris from the Lake Samish outlet
channel; and,
WHEREAS, on August 8, 2006, following the establishment of the Samish
Watershed Subzone, the Whatcom County Council in Ordinance No. 2006 -034,
acting in its role as the Flood Control Zone District Board of Supervisors, set the
assessments for properties within the Samish Watershed Subzone, but did not
specify or otherwise set a limit upon the period of time during which the
assessments would be charged; and
WHEREAS, $17,254 in annual revenue is needed at least through 2016 to
maintain and operate the Friday Creek dam and remove debris from the Lake
Samish outlet channel; and,
I WHEREAS, the County Council acting as the FCZD Board of Supervisors
2 wishes to limit imposition of the assessment previously approved to a period of no
3 longer than ten years, during and after which the Council may review the
4 assessment and take whatever action in regard to the assessment and the time -
5 period for its imposition that it deems to be appropriate within the constraints of the
6 law;

NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that
an annual assessment of $0.23 per lake frontage foot, with a minimum lake
frontage assessment of $2.30 and $14.94 per domestic unit, previously levied for
the Samish Watershed Subzone in Ordinance 2006 -034, shall be in effect through
the year 2016, subject to further amendment of the Council, provided that revenue
from said charges shall be administered in accordance with the provisions of RCW
86.15 and in compliance with RCW 86.09.
