RESOLUTION NO. 2007 -058
DIRECTING ADMINISTRATIVE SERVICES TO EMPLOY CONTRACTOR
TO BID EXCESS MEDICAL PLAN INSURANCE
WHEREAS, RCW 39.04.280 requires municipalities to award contracts based on
competitive bidding processes; and
WHEREAS, said statute allows the County Council to establish exemptions from
competitive bidding requirements for purchases of insurance or bonds; and
WHEREAS, Whatcom County Code Section 3.08.060.A also addresses this issue of
procurement and provides that the County Council may waive bidding requirements upon
recommendation of the County Executive if it finds that such a waiver will be in the best interest of
the County; and
WHEREAS, the County Executive has recommended that such a waiver be adopted by the
County Council for the purposes stated hereinafter; and
WHEREAS, the excess insurance market for self- insured medical plans is a specialized
market requiring specialized expertise to seek and analyze quotes; and
WHEREAS, the County has engaged qualified benefits consulting and third party
administrators through competitive processes to assist the County with administration of its self -
insured medical plan; and
WHEREAS, the process of obtaining and analyzing favorable quotes for January I"
coverage is based on confidential claims cost information not available within the schedule required
for a full Request for Proposal process if conducted by Whatcom County;
NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that the
County Administrative Services Department is directed to authorize the benefits consulting
contractor and third party administrator for the self - insured medical plan to elicit competitive
quotes from the reinsurance market and to recommend an excess medical insurance carrier applying
best pricing and favorable coverage for participants on the self - insured medical plan; and
BE IT FINALLY RESOLVED that this resolution shall also be effective for future years
without need for further Council action, and that the Administrative Services Department be

authorized to request annually that the benefits contractors, whoever they may be, perform the call
for excess insurance coverage quotes within time frames to afford coverage at the start of the
medical plan year.
