RESOLUTION NO. 2007 -008
ESTABLISHING THE PUBLIC HEARING PROCESS FOR
DEVELOPMENT AGREEMENTS UNDER THE GROWTH MANAGEMENT ACT
WHEREAS, the Washington State Growth Management Act authorizes local
government to enter into development agreements (RCW 36.70B.170); and
WHEREAS, the Washington State Growth Management Act authorizes the County
Council to designate a body to conduct the public hearing (RCW 36.706.200); and
WHEREAS, the Washington State Legislature intended in allowing development
agreements to provide certainty, encourage the commitment to comprehensive
planning, strengthen the public planning process, and reduce the economic costs of
development; and
WHEREAS, the Whatcom County Unified Fee Schedule establishes a fee for
review of GMA Development Agreements (UFS 8041).
NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council:
1. The Whatcom County Hearing Examiner is designated to conduct the open
record public hearing for development agreements as defined in the Growth
Management Act, RCW 36.706.
2. The Whatcom County Hearing Examiner shall conduct an open record hearing
and pre a record thereof, and make recommendation to the County
