RESOLUTION NO. 2008 -085
Authorizing Executive to Transfer Unexpended General Fund
Budget Authority to Superior Court
WHEREAS, the approved 2008 budget included $5,238,873 to fund operations of
Superior Court Administration and the Office of the County Clerk, and;
WHEREAS, Superior Court has exceeded their budget, needed year -end
supplementals or used restricted appropriation authority to cover budget shortfalls in 6 of the last
7 years, and;
WHEREAS, Superior Court will likely exceed its 2008 budget by approximately
$147,000 to approximately $177,000 as a result of exceeding budgets for commissioners pro -
tem, jury expenses and guardians ad litem, and;
WHEREAS, RCW 36.40.130 states that expenditures made in excess of budget
appropriations shall not be the liability of the county, but that of the official making or incurring
such expenditures; however, the County Executive wishes to avoid this exposure to the Court
Officials by requesting the Council to adopt this Resolution,
NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that the
Council hereby authorizes the Whatcom County Executive to transfer unused budget authority
within the existing 2008 General Fund Budget to cover Superior Court expenditures exceeding
the currently approved Superior Court Administration and County Clerk's budget.
