October 21, 2008 6 8 RESOLUTION NO. 2008 -082 10 (A resolution of the Whatcom County Flood Control Zone District Board of Supervisors) 11 12 ADOPTING THE 2009 BUDGET FOR THE 13 WHATCOM COUNTY FLOOD CONTROL ZONE DISTRICT AND SUBZONES 14 15 16 WHEREAS, RCW 86.15.140 requires that the Board of Supervisors of each 17 flood control zone district and subzone adopt a budget for the zone at the same time 18 that county budgets are considered; and 19 20 WHEREAS, the statute further requires that the zone or subzone budget be 21 divided into four appropriation items: overhead and administration, maintenance 22 and operation; construction and improvements, and bond retirement and interest; 23 and 24 25 WHEREAS, under the appropriation item for construction and improvements, 26 the Board is required to list each flood control improvement or storm water control 27 improvement and the estimated expenditure for each during the next year; and 28 29 WHEREAS, the budget may only be adopted after a public hearing for which 30 proper notice has been given; and 31 32 WHEREAS, Fund No. 169, the Flood Control Zone District fund has been 33 managed by the County for purposes of funding flood control and water resource 34 projects implemented by the county that are consistent with the powers of the 35 district under RCW 86.15; and 36 37 WHEREAS, funds obtained by the County through grants or cooperative 38 agreements for flood control have also been managed through Fund No. 169; and 39 40 WHEREAS, the Board of Supervisors intends to establish a delineation of the 41 roles of the district and the county and to effect a clear separation of the finances of 42 the district and the county by entering into an interlocal agreement governing the 43 transfer of funds from the district to the county for implementation of an approved 44 annual work plan, and financial reporting requirements to insure transparent 45 accounting of all public funds; and 46 47 WHEREAS, the 2009 budget proposed by the County Executive for Whatcom 48 County includes proposed expenditures out of Fund 169 to pay for flood control and 49 water resources projects consistent with the powers of the District under 86.15; and 50 51 WHEREAS, there is a substantial amount of accounting work that is 52 necessary to accurately separate out county flood control funds from funds belonging 53 to the Flood Control Zone District, all of which are currently kept in Fund No. 169, 54 and that accounting work can not be accomplished before the 2009 county and 55 district budgets must be approved; and 1 2 3 4 5 6 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 WHEREAS, the Board of Supervisors intends to effect a separation of finances between the county and the district as soon as possible; and WHEREAS, the budgets for expenditures from the four subzone funds are also included in the County Executive's proposed budget ordinance; NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors approves the 2009 budgets for the four flood control subzones (Acme /Van Zandt, Sumas /Nooksack /Everson; Lynden /Everson and Lake Samish) as presented in the County Executive's proposed county budget; and BE IT FURTHER RESOLVED, that the Board of Supervisors approves the appropriation and expenditure of Flood Control Zone District funds from Fund No. 169 for 2009 only in the adopted 2009 -10 Whatcom County budget; and BE IT FURTHER RESOLVED, that the Board of Supervisors requests the County to bring forward no later than December 9, 2008, a series of interlocal agreements between the district and subzones and the County to establish financial . management and administrative separation between the district /subzones and the County; and BE IT FINALLY RESOLVED, that the Board of Supervisors further requests that the County complete the accounting work necessary to effect a separation of County and District funds, and complete any necessary budget amendments to reflect the separation of the funds and their management for consideration of the Board of Supervisors no later than April 14, 20096 APPROVED this 25th day of November , 20081 Y Co '�,••W HAT•.• / 2 CIO U" 40 woo Darya Brown -E)Ws, Ck of the Council APPRO \4ED AS TO FORM: uty Prosecutor WHATCOM COUNTY FLOOD CONTROL ZONE DISTRICT BOARD OF SUPERVISORS WHATCOM COUNTY, WASHINGTON Carl Weimer, Chair
