7 RESCINDING PARTS OF ORDINANCE 98 -085 AND RESCINDING WHATCOM
8 COUNTY CODE CHAPTER 2.93 IN ITS ENTIRETY

10 WHEREAS, in Ordinance 98 -085, the Whatcom County Council took action to direct
11 codification of the enactments of the Whatcom County Flood Control Zone District (FCZD)
12 Supervisors in the Whatcom County Code Title 17A; and
13
14 WHEREAS, no such enactments have ever been codified into Title 17A; and
15
16 WHEREAS, the inclusion of the enactments of the Board of Supervisors in the Whatcom
17 County Code leads to unnecessary confusion of the actions of the County Council and the FCZD
18 Board of Supervisors; and
19
20 WHEREAS, the FCZD-Board of Supervisors has determined that its enactments would be
21 best collected and published as a separately tabbed document within the Whatcom County Code
22 binder and the Council concurs with this determination;
23
24 WHEREAS, the FCZD Board of Supervisors has adopted a resolution governing the
25 operations of all FCZD subzone advisory committees and WCC 2.93 deals only with one subzone
26 and could cause confusion if not rescinded;
27
28 NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that the final
29 paragraph of Ordinance 98 -085 calling for the codification of FCZD enactments into Title 17A is
30 hereby rescinded, and Whatcom County Code 2.93 is rescinded in its entirety.
