Birch Bay Water and Sewer District has submitted their May 2009 Comprehensive Sewer System Plan to the County for review and approval. Per
RCW 57.16.010(6),all comprehensive sewerr system plans must be either approved,conditionally approved,or rejected by the legislative authority
of the county in which the district is located.

RESOLUTION NO.2009-049
APPROVING THE BIRCH BAY WATER AND SEWER DISTRICT
COMPREHENSIVE SEWER SYSTEM PLAN
WHEREAS, on June 23, 2009, the Birch Bay Water and Sewer District
submitted a proposed Comprehensive Sewer System Plan, dated May 2009, to
Whatcom County for review and approval; and
WHEREAS, RCW 57.16.010(6) requires that all comprehensive water and
sewer system plans, and plan amendments, be either approved, conditionally
approved, or rejected by the legislative authority of the county in which the district
is located; and
WHEREAS, as required by RCW 57.16.010(6), the Whatcom County Health
Department and Whatcom County Public Works Engineering Division have reviewed the
proposed amendment and submitted letters of approval to the County Council; and
WHEREAS, the proposed amendment complies with the criteria set forth in
RCW 57.02.040 and RCW 57.16.010(6).
NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that
the Birch Bay Water And Sewer District Comprehensive Water System Plan, dated
May 2009, is hereby approved as presented.
