The attached Resolution in the Matter of Considering Vacating a Portion of Edwards Drive is submitted per
RCW 58. 17 & 36. 87 and WCC 12-20.
Adoption of this resolution will trigger the County Engineer to report on the proposed vacation at a future
Council meeting. Once the County Engineer's report is submitted the actual road vacation will be considered
by Council under a separate resolution and a public hearing will need to be scheduled.

6 A RESOLUTION IN THE MATTER OF CONSIDERING
7 VACATING A PORTION OF EDWARDS DRIVE

9 WHEREAS, on July 15, 2003 ; David Duncan, submitted a petition for the vacation of a portion of
10 Edwards Drive lying within the unincorporated area of Whatcom County, accompanied by the penal
11 sum of $682.00, and,
12 WHEREAS, as described in RCW 36. 87.010, when a county road or any part thereof is considered
13 useless the Whatcom County Council may declare its . intention to formally consider vacation, by
14 resolution.
15 NOW, THEREFORE, BE IT RESOLVED that it is the intention of Whatcom County
16 Council to consider vacation of the following described right of way: Beginning at
17 the Northeast corner of Lot 7, "Largaud' s Island Vista," Point Roberts, Whatcom
18 County, Washington, as per the plat thereof, recorded in Book 8 of Plats, page 75 , in
19 the Auditor' s office of said county and state; thence North along the East line of said
20 plat to a line 30. 00 feet Southerly and parallel to the centerline of Edwards Drive;
21 thence S .76°35 ' W. along said parallel line to the Northerly prolongation of the West
22 line of said Lot 7 ; thence South, along said Northerly prolongation to the Northwest
23 corner of said Lot 7; thence N. 76°35 'E. along the Northerly line of said Lot 7 to the
24 Point of Beginning. Containing 1 ,213 square feet, more or less. Situate in Whatcom
25 County, Washington.

27 Subject to and/or together with all easements, covenants, restrictions and/or
28 • agreements of record or otherwise. Also subject to Whatcom County retaining
29 an easement the length of the area to be vacated for utilities and drainage.

31 AND BE IT FURTHER RESOLVED that the County Engineer investigate and report to the County
32 Council on the matter of the proposed vacation of said portion of Edwards Drive so that the Council
33 may set a public hearing on the matter.
