16 ESTABLISHING A MINIMUM BALANCE FOR THE FLOOD CONTROL
17 ZONE DISTRICT FUND TO MAINTAIN AS AN EMERGENCY AND OPERATING

21 WHEREAS, on October 22 , 1991 the Whatcom County Council adopted
22 Ordinance 91 - 076 creating a county-wide Flood Control Zone District ( District) , and
23
24 WHEREAS, the District was created to provide comprehensive flooding
25 response including maintenance of levees, dikes and other flood control
26 infrastructure, disaster response, repair of flood damages, and construction of flood
27 control system improvements that reduce future flood damages in the Nooksack
28 River watershed and other watersheds in Whatcom County ; and

30 WHEREAS, demand for District resources has increased to address other
31 water resource issues, including stormwater management, salmon recovery, marine
32 resource protection , water resource planning , and long -term watershed
33 management ; and

• 35 WHEREAS, in accordance with . RCW 86 . 15 , much of the additional work has
36 been funded using District tax revenues and the District fund balance has declined ;
37 and
38
39 WHEREAS, substantial financial resources are necessary to enable timely
40 response and recovery measures during a flooding disaster and to maintain adequate
41 operating reserves to keep the District solvent ; and
42
43 WHEREAS, past flood response and recovery costs for Whatcom County and
44 other Counties in the Puget Sound region demonstrate that an emergency reserve of
45 five ( 5 ) million dollars is appropriate ; and
46
47 NOW THEREFORE BE IT RESOLVED by the Whatcom County Flood Control Zone
48 District Board of Supervisors that a minimum balance of five ( 5 ) million dollars will
49 be reserved in the District fund.. Unless otherwise authorized by the Board of
50 Supervisors, expenditures that draw the fund below the reserved amount are allowed
51 only for ( 1 ) responding to and recovering from flooding disasters declared by the
52 . Whatcom County Executive or his/ her designee and ( 2) financing day-to- day
1 operations of the District whereby the current Fiscal Year ending fund balance shall
2 not be less than the reserve amount.
