( ) Yes ( . ) NO Requested Date: 10 / 26 / 2010 SUMMARY STATEMENT OR LEGAL NOTICE LANGUAGE: Per RCW and Whatcom County Code, the Whatcom County Property Management Committee has recommended the sale of the Finsrud Quarry, county parcel number 390422430080, as surplus property. The property is approximately 9.34 acres, and is to be sold by sealed bid with the minimum sale price of $ 135,000 (one hundred thirty five thousand dollars) per the August 11 , 2010, appraisal prepared by Wm. T. Follis, LLC. COMMITTEE ACTION: COUNCIL ACTION: • 10 / 12 / 2010 : Introduced 10/26/2010 : Council Approved 7 -0 Res . 2010-040 • Related County Contract #: Related File Numbers: Ordinance or Resolution Number: Res . 2010-040 Please Note: Once adopted and signed, ordinances and resolutions are available for viewing and printing on the County 's website at: www. co. whatcom. wa. us/council. 1 SPONSORED BY: Cosent 2 PROPOSED BY: Public Works 3 INTRODUCTION DATE: 10 / 12 / 2010 4 RESOLUTION NO. ? 010-040 5 6 RESOLUTION APPROVING SALE OF FINSRUD QUARRY 7 AS SURPLUS REAL PROPERTY 8 9 WHEREAS, RCW 36.34.005 authorizes counties to establish comprehensive procedures for the 10 management of county property, including the sale of surplus real estate where it is found to be in the best 11 interest of a county to sell same; and 12 13 WHEREAS, in Whatcom County Code (WCC), Chapter 1 . 10, Whatcom County has established 14 those procedures; and 15 16 WHEREAS, the Whatcom County Property Management Committee has recommended the sale of 17 Whatcom County real property known as Finsrud Quarry as a potential residential property to the highest 18 bidder, by sealed bid, for not less than the appraisal amount as listed below, plus costs; and 19 20 WHEREAS, WCC 1 . 10.310 authorizes the Council, after receipt of estimated market values from 21 the Property Management Committee, to establish limitations and conditions upon sale of property, such as 22 the minimum price for said units of property and whether or not a contract will be allowed, or if it will be a 23 cash price; and 24 25 WHEREAS, WCC 1 . 10.310, as well as state law, allows the County to reserve from the sale oil, 26 gas, timber, mineral aggregates and other resources if the Council finds that it is the best interest of the 27 public to reserve these; 28 29 NOW, THEREFORE, BE IT RESOLVED that it is the best interest of the County to sell Finsrud 30 Quarry to the highest bidder by sealed bid. 31 32 LEGAL DESCRIPTION OF PROPERTY TO BE SOLD 33 34 Sell parcel No. 390422 430080 0000 (Approximately 9. 34 acres, more or less) 35 36 A tract of land located in the Southeast quarter, Southeast quarter of Section 22, Township 39 North, 37 Range 4 East of W.M., and described as follows: 38 39 Beginning at the South quarter corner of said Section 22; thence South 87° 11 ' East along the South line of 40 the Southeast quarter of said Section 22, 1 ,774.39 feet; thence North 30° 11 ' West 200 .00 feet to the true 41 point of beginning; thence North 30° 11 ' West 617 .3 feet to the West line of said Southwest quarter, 42 Southeast quarter; thence North 2° 15 ' 35" West along said West line 600 .08 feet; thence South 87° 11 ' 43 East 280 . 14 feet; thence South 20° 52 ' 34 ' East 855 .00 feet; thence South 19° 25 ' 20" West 233 .31 feet; 44 thence South 59° 49 ' West 200.00 feet to the true point of beginning. 45 46 Situate in Whatcom County, Washington. 47 48 49 1 2 BE IT FURTHER RESOLVED that the minimum bid for the parcels listed above shall be no less than the 3 appraised value of $ 135 ,000 .00 (one hundred thirty five thousand dollars) and that Buyer will pay any 4 additional Buyer closing costs normally associated with such a real property transaction; and 5 6 BE IT FURTHER RESOLVED that transfer of said real property be by quitclaim deed and that Buyer will 7 represent and warrant in writing to Seller Whatcom County, that Buyer has thoroughly inspected and 8 evaluated the properties for sell, to Buyer' s complete satisfaction and Buyer accepts the properties AS-IS 9 with full knowledge of potential liability the Buyer could incur for any environmental hazards or 10 conditions affecting the properties, including, but not limited to, state or federal-mandated reclamation of 11 the properties. Buyer agrees that the purchase price of the properties reflects the agreed upon value of the 12 properties AS-IS, taking into account the aforementioned disclosures; and 13 14 BE IT FURTHER RESOLVED that said purchase of said real properties shall not be allowed under 15 contract and shall be paid either in cash, certified check or money order to the Whatcom County Treasurer 16 at the time of sale; and 17 18 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby directed to sell said property 19 at no less than the appraised value of $ 135 ,000 .00 (one hundred thirty five thousand dollars) and that said 20 sale shall take place in accordance with the duties as established in WCC 1 . 10.290- 1 . 10.390.
