SUMMARY STATEMENT OR LEGAL NOTICE LANGUAGE:
The Washington State Legislature has appropriated funds to clean up naturally occurring asbestos from
Swift Creek. Michael and Marilyn Parker own real property located at 3421 South Pass Road, Everson.
The Whatcom County Flood Control Zone District (FCZD) and the State of Washington have identified
this property as desirable for controlling naturally occurring asbestos. Budget authority exists in the
FCZD 2010 budget. The acquisition needs to be approved by the Flood Control Zone District Council
Board of Supervisors.

6 A RESOLUTION TO APPROVE PURCHASE & SALE
7 AGREEMENT FOR 3421 SOUTH PASS ROAD EVERSON

9 WHEREAS, the Washington State Legislature passed Engrossed Substitute House Bill 2687
10 "ESHB 2687" during the 2009 Legislative Session, appropriating funds "solely to clean up naturally
11 occurring asbestos from Swift Creek"; and
12
13 WHEREAS, Michael and Marilyn Parker (recently deceased) own real property commonly
14 referred to as the "Parker Property" located at 3421 South Pass Road, Everson; and
15
16 WHEREAS, the Parker Property has been identified by Whatcom County Flood Control Zone
17 District (District) and the State of Washington as desirable for controlling naturally occurring asbestos
18 from Swift Creek on and around South Pass Road and Oat-Coles Road; and
19
20 WHEREAS, the Sumas/Nooksack/Everson Subzone is in favor of the acquisition; and
21
22 WHEREAS; the Parker Property contains a house, shop and several outbuildings on 14.25 acres
23 and was appraised at $360,000; and
24
25 WHEREAS, Michael and Marilyn Parker (recently deceased) have agreed to sell their property to
26 Whatcom County for its appraised value of three hundred sixty thousand dollars ( $360,000.00), plus
27 closing costs.

29 NOW, THEREFORE, BE IT RESOLVED that the Whatcom County Council, acting as the
30 Whatcom County Flood Control Zone District Board of Supervisors, authorize the County Executive,
31 acting on behalf of the FCZD, to purchase the Parker Property.
