9 Repealing Ordinance # 2004-049 and
10 Amending the Official County Zoning Map

12 WHEREAS , during the recent process to review all of the County's urban growth areas
13 pursuant to the Growth Management Act the County Executive proposed , among other things,
14 to remove the requirements of Ordinance # 2004- 049, on a portion of the Birch Bay Urban
15 Growth Area to which it applies ; and
16
17 WHEREAS, the Whatcom County Planning Commission concurred with that
18 recommendation following a public hearing on the matter on September 17 , 2009, held jointly
19 with the Whatcom County Council and forwarded a recommendation to the council to repeal
20 Ordinance # 2004 - 049 ; and

22 WHEREAS , the Whatcom County Council finds that the provisions of Ordinance # 2004-
23 049 impose unreasonable obstacles to the development of the properties to which the ordinance
24 applies and should be repealed in its entirety .

26 NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that Ordinance
27 # 2004- 049 is repealed in its entirety and the Official County Zoning Map is revised as shown in
28 Exhibit A .
