8 ESTABLISHING THE INTENT OF THE WHATCOM COUNTY COUNCIL
9 TO CONDUCT A HEARING IN CONSIDERATION OF CREATING A
10 " NO SHOOTING ZONE" IN THE GLENHAVEN LAKES AREA
11
12 WHEREAS, pursuant to the Whatcom County Code Chapter 9 . 32 . 010 , a no shooting
13 zone" is an area designated by the county council in which the discharge of firearms is
14 prohibited ; and
15
16 WHEREAS, the Whatcom County Council is elected to represent the concerns of the
17 citizens of Whatcom County and is charged with the broad responsibility of protecting the
18 health , safety and general welfare of the public; and
19
20 WHEREAS, pursuant to Whatcom County Code Chapter 9 . 32 . 020 and the Revised
21 Code of Washington 36 . 32 . 120 , the county council has the authority and power to establish
22 no shooting zones ; and
23
24 WHEREAS, pursuant to Whatcom County Code Chapter 9 . 32 . 050 , the creation of a
25 no shooting zone could result in the imposition of civil penalties ; and
26
27 WHEREAS, the Revised Code of Washington 9 . 41 . 300 ( 2 ) specifically states that
28 counties may enact laws and ordinances restricting the discharge of firearms in any portion
29 of their respective jurisdiction where there is a reasonable likelihood that humans, domestic
30 animals or property will be jeopardized ; and

32 WHEREAS, the Glenhaven Lakes area in southern Whatcom County, which includes
33 both Cain Lake and Reed Lake, has a population and residential housing density development
34 pattern that is more urban in nature than the remainder of the rural portions of Whatcom
35 County ; and
36
37 WHEREAS, a number of citizens residing in this area have requested this restriction
38 on the discharge of firearms as a means to promote public safety and welfare ; and
39
40 WHEREAS, twenty two other such " no shooting zones" are already established
41 throughout unincorporated Whatcom County in densely populated areas as a means to
42 protect the public safety and welfare ; and

2 WHEREAS, the Whatcom County Council hereby requests public comment on the
3 proposed no shooting zone, including any and all County departments, before scheduling
4 the matter for public hearing ; and
5
6 WHEREAS, the Council cannot create the no shooting zone without first having a
7 hearing on the proposal , and such hearing date is yet to be announced ; and
8
9 NOW THEREFORE, BE IT RESOLVED by the Whatcom County Council that a
10 hearing will be conducted to consider an amendment to Whatcom County Code 9 . 32 as
11 indicated in Exhibit A to this resolution .

No Shooting Zone
This No Shooting Zone is intended to represent all of the residentially zoned land in portions of Sections
29 and 32, Township 37 North, Range 4 East, Whatcom County, Washington per Title 20 as designated at
the time of adoption of the ordinance codified in this section lying Westerly of Cain lake Road and
Easterly and Southerly of Commercial Forest Lands as shown on aforesaid map . Said Zone more
particularly described as follows;
All of the Southwest Quarter of Section 29, Township 37 North, Range 4 East,
And all of the Southeast Quarter of the Northwest Quarter of said Section 29,
And all of the Southwest Quarter of the Northeast Quarter of said Section 29 lying Westerly of
Cain Lake Road,
And all that portion of the West Half of Section 32, Township 37 North, Range 4 East of W. M .
and the Southwest quarter of the Southeast quarter of said Section 32, all lying Westerly of Cain
lake Road .
Basis of Description : All divisions of Glenhaven Lakes , the Plat of Cain's Lake and the above cited Title
