WHEREAS, RCW 57 . 16 . 010 ( 6 ) requires that all comprehensive water and sewer system plans, and plan amendments, be either approved , conditionally approved , or - rejected by the legislative authority of the county in which the district is located ; and WHEREAS, as required by RCW 57 . 16. 010 ( 6 ) , the Whatcom County Health Department has reviewed the proposed amendment and submitted a letter of approval to the County Council ; and WHEREAS, as required by RCW 57 . 16 . 010 ( 6 ) , the Whatcom County Public Works Engineering Division has submitted a letter of approval to the County Council , with the following clarifications noted : 1 . All work that the District performs in a County right- of- way requires a Revocable Encroachment Permit . 2 . Depending on the scope of work on any given District planned water system facilities project, the County might also require : a . Other permits ( e . g . , building , conditional use , land disturbance , shoreline ) as a prerequisite to project execution . b . Stormwater management related documentation , with possible consequent engineered stormwater management system design . 3 . Where feasible , the District is encouraged to place new water system facilities outside the existing pavement of any improved County roadway to minimize disturbance to roadway surfaces . 4 . To the maximum extent feasible , the District is encouraged to accomplish planned water system projects that involve work in County right- of- ways in advance of County planned road project to minimize the need for roadway patching . 1 • NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that Amendment # 1 to the Birch Bay Water and Sewer District's Comprehensive Water System Plan , dated September, 2010 , is hereby approved as presented . `$‘‘` PPRO ly is 25th day of January . , 2011 . The subject Plan was approved by the State Department of Health (DOH) on December 14, 2009 , and by Whatcom County Council on September 15 , 2009. In May 2008 , the District and BP West Coast Products, LLC (BP) entered into an agreement to supply potable water to the BP Cherry Point Refinery, subject to two conditions, both of which have been satisfied . The purpose of this amendment is to update those portions of the Plan that are changed as a result of the District's agreement to provide retail potable water =, - al service to the BP Cherry Point Refinery and the second amendment to the City of Blaine water supply contract. r The Comprehensive Water System Plan dated March 2009 and adopted April 9 , 2009 remains in full force and effect, except where modified by this Amendment. AMENDMENTS TO EXECUTIVE SUMMARY Replace the third paragraph under Existing System , page ES-1 , with the following paragraph : The District provides retail potable water service directly to the BP Cherry Point Refinery by agreement, pursuant to which the District agrees to sell and BP agrees to purchase a supply of potable water. Previously the District provided water to the BP Cherry Point Refinery via an intertie and contract with Whatcom County PUD No. 1 . The. District's original agreement with . the PUD ( 1990) had been amended five times since August 2006 to address short-term water supply and contract negotiation _ , 1 The Whatcom. County Comprehensive Plan was updated in November 2009. Related land use and zoning changes were made within the area served by the District, including removal of some areas from the Birch Bay or Blaine UGAs. However, some developments may have vested rights to develop significdnt areas of land at densities higher than allowed under the recently adopted rural designation. Additionally requests for changes to the UGA have been filed with the County. It will be some time before applicable. development densities are confirmed for those areas. Therefore, this amendment does not address recent changes in the UGA. . . Amendment") . The Sixth Amendment was executed concurrently with a "Superseding Agreement" between the District and BP for delivery of , water directly to BP . The District has recently secured additional water supply via the City. The District also recently submitted , to the Whatcom County Boundary Review Board (BRB) , a Notice of. Intention to provide potable water service directly to BP by agreement. The BRB did not . invoke jurisdiction . The additional water supply and completion of the BRB process were the two conditions precedent for the Superseding Agreement to be effective. The District provided notice of satisfaction of the first condition on August 17, 2010 and of the second condition on September 27 , 2010 . The BP supply agreement (May 2008) will vest and become effective thirty days following the second notice of satisfaction . Replace the first paragraph under System Analysis and Capital Improvement Program , page ES-3 , with the following paragraph : The Blaine water supply contract will provide adequate water supply through the year 2030 , at the forecast demand . Replace the last paragraph under System Analysis and Capital Improvement Program , page ES-5 , with the following paragraph : System deficiencies are summarized in Section 3 .4 and proposed . improvements are discussed in Section 3 . 5 and Chapter 8 . The purpose of the Comprehensive Water System Plan (WSP) . is to identify the retail service area per RCW 90. 03. 383(2)(b) and RCW . 46 . 20.260 , existing system , service policies, future needs and related issues, in a manner which is consistent with the Whatcom County Comprehensive Plan, the Growth Management Act, WAC . 246-290 , and other local , state and federal laws. The District also has one well , three reservoirs, four pump stations and a complete water transmission and distribution system . In 2002 , the District negotiated a new contract with the City of Blaine, providing for up to 2. 11 million gallons per day of water supply to the District. This is a 30-year contract, with potential renewal of up to 30 more years.
