PROPOSED BY: SHERIFF'S OFFICE SPONSORED BY: CONSENT INTRODUCTION DATE : JUNE 7, 2011 ORDINANCE NO. 2011 -022 REPEALING WHATCOM COUNTY CODE SECTION 9 . 20, CURFEW WHEREAS, the United States Court of Appeals, Ninth Circuit, in Nunez by Nunez v. City of San Diego ( 114 F. 3d 935 ) , found that the City of San Diego 's general curfew ordinance was unconstitutionally vague on June 9 , 1997 ; and WHEREAS, the Washington State Court of Appeals, Division I, in State v. J. D. ( 937 P . 2d 630 ) found a City of Bellingham curfew ordinance to be unconstitutionally vague on June 2, 1997 ; and WHEREAS,the Whatcom County curfew ordinance, WCC 9 . 20 , is more vague than the former City of Bellingham ordinance ; and WHEREAS, the Whatcom County Prosecutor's Office has determined that the county curfew ordinance would almost certainly be found to be unconstitutional if challenged in court ; and WHEREAS, the Whatcom County Sheriffs Office, on guidance from the Prosecutor's Office, has not been enforcing the county curfew ordinance .
