SPONSORED BY : Consent PROPOSED BY : PDS INTRODUCTION DATE : 10 / 26 / 2010 ORDINANCE NO . 2011 - 018 AN ORDINANCE AMENDING COMPREHENSIVE PLAN CHAPTER 4 CAPITAL FACILITIES FOR FIRE PROTECTION LEVEL OF SERVICE WHEREAS, On November 24 , 2009 ordinance 2009 - 0071 was adopted by the Whatcom County Council . The ordinance adopted amendments to Chapter Four - Capital Facilities adding policy 4H - 3 relating to the adoption of a fire level of service standards . WHEREAS, In 2010 the county council docketed amendments to the Whatcom county comprehensive plan related to the adoption of a fire level of service standards . WHEREAS, On March 11 , 2010 and April 8 , 2010 the Planning Commission had work sessions on county wide Fire Level of Service ( LOS ) Standards . WHEREAS, On April 22 , 2010 the Planning Commission held a public hearing on countywide Fire LOS Standards . WHEREAS, On May 27 , 2010 the Planning Commission held a work session on countywide Fire LOS standards . WHEREAS, On July 14 , 2010 the Planning Commission held a Town Hall meeting at the Deming Library present to the public the Planning Commission 's recommendation on fire LOS . WHEREAS, On July 15 , 2010 the Planning Commission held a Town Hall meeting at Fire Station 46 at 6081 Church rd to present to the public the Planning Commission 's recommendation on fire LOS . WHEREAS, Notice of the Whatcom County Planning Commission public hearing was published August 1 , 2010 . A public hearing was held by the. Planning Commission on August 12 , 2010 . WHEREAS, On September 9 , 2010 the Planning Commission had a work session and took final action . CONCLUSION The proposal meets all of the legal requirements including compliance with the criteria of WCC 2 . 160 . 080 . The proposed amendment is compatible with the Growth Management Act, Whatcom County Comprehensive Plan Goals and Policies, along with policies within Whatcom County's County Wide Planning Policies . Approval of this amendment is in the public interest . On November 24, 2009 ordinance 2009 - 0071 was adopted by the Whatcom County Council . The ordinance adopted amendments to Chapter Four - Capital Facilities adding policy 4H - 3 relating to the adoption of Fire level of service standards . 2 . Policy 4H - 3 from the Capital Facilities chapter of the Whatcom County Comprehensive Plan states , " Whatcom County should define an urban level of service for fire protection by December 1 , 2011 . " 3 . The arrival of first responders with automatic external defibrillator capability before the onset of brain death , and the arrival of adequate fire suppression resources before flash - over is a critical event during the mitigation of an emergency , and is in the public' s best interest . This section is for primarily paid departments a service you would find in urban areas . RCW 52 . 33 . 010 . 4 . A study was conducted showing what other counties and some like size cities ( similar in size to Birch Bay and Columbia Valley UGA's ) in Washington State are using for a Fire Level of Service . 5 . Whatcom County is the authority having jurisdiction for Fire Level of Service for all fire districts in unincorporated Whatcom County . The adopted LOS is to be used for all capital facilities planning under the growth management act as well as setting mitigation and/or impact fees that are collected by the fire districts . 6 . Three planning commission work sessions , two town hall meetings, and two public hearings were held in front of the Planning Commission . The public sent a clear message to staff and the Planning Commission that they are pleased with the current level of service the fire districts are delivering to them and they would like the fire level of service to be set at what it is currently being provided . 7 . The Whatcom County Planning and Development Services SEPA Official issued a SEPA Determination of Non - Significance ( DNS ) on July 19 , 2010 . 8 . On , August 2 , 2010 a 60 Day Notice of Review consistent with RCW 36 . 70A . 106 was sent to Department of Commerce for the proposed comprehensive plan amendment . The 7 - year comprehensive plan review and update process should demonstrate that the urban growth areas are served by urban levels of fire protection facilities and service . If the level of service standard adopted by the County can not be provided over the 20 -year planning period , then re - designation of UGAs to rural designations should be considered . Policy 4H -4 Urban levels of service for fire protection shall be a response time of 8 minutes 80 % of the time when the department covering the urban area has staffed the fire station . When the fire station is not staffed the response time shall be 10 minutes 80 % of the time , or a WSRB Rating of a 6 . Rural levels of service for fire protection shall be a response time of 12 minutes 80 % of the time when the department covering the rural area has staffed the fire station . When the fire station is not staffed the response time shall be 14 minutes 80 % of the time , or a WSRB Rating of an 8 . Staffed station shall be a fire station that is staffed 24 hours a day 7 days a week 365 days a year . Staff may be paid , volunteer, or combination of the two .
