ORDINANCE # 2011 -001
IMPOSING AN EMERGENCY INTERIM MORATORIUM ON THE ACCEPTANCE OF NEW
APPLICATIONS FOR SUBDIVISIONS AND SHORT SUBDIVISIONS
IN RURAL AREAS
WHEREAS, the Whatcom County Council is in the process of considering changes to
the Whatcom County Comprehensive Plan , official zoning map and development codes
related to the Rural Element for compliance with the Growth Management Act ( GMA) ; and
WHEREAS, the changes are being considered in response to the finding of
noncompliance in Western Washington Growth Management Hearings Board ( WWGMHB)
Case No . 05 - 2- 0013 ; and
WHEREAS, on October 26 , 2010 , the Council adopted Ordinance No . 2010 - 053 , an
ordinance imposing an emergency interim moratorium on the acceptance of new
applications for subdivisions and short subdivisions for divisions of property into parcels
smaller than ten ( 10 ) acres within areas proposed for rezoning to R- 10A or RR- 10A under
the October 8 , 2009 recommendation of the Whatcom County Planning Commission ;
WHEREAS, this interim moratorium was extended for up to six ( 6 ) months on
December 7 , 2010 , with the adoption of Ordinance No . 2010 - 066 ;
WHEREAS, with the interim moratorium in effect, property in the rural areas
affected by the original Final Decision and Order of the WWGMHB in Case No . 05 - 2- 0013 ,
except for the areas within the boundaries of the LAMIRDs recommended by the Planning
Commission in its October 8 , 2009 decision , can only be divided into parcels that are 10
acres in size or larger ;
WHEREAS, on December 22 , 2010 , the WWGMHB issued a decision entering a
Determination of Invalidity in Case No . 05 - 2- 0013 as to the County's LAMIRD designation
criteria in the Whatcom County Comprehensive Plan ;
WHEREAS , in its decision , the WWGMHB relied on the fact that the County was
continuing to allow more intense development in the areas within the boundaries of the
LAMIRDs recommended by the Planning Commission in its October 8 , 2009 decision ;
WHEREAS, in response to the Determination of Invalidity, the Council has decided
to extend the interim moratorium to the areas within the boundaries of the LAMIRDs
recommended by the Planning Commission in its October 8 , 2009 decision ;
WHEREAS, Section 2 . 40 of the Whatcom County Charter allows for the adoption of
an emergency ordinance for the immediate preservation of the public peace , health , or
safety or support of the county government and its existing institutions ; and
WHEREAS, the Whatcom County Charter limits an emergency ordinance to a period
not to exceed 60 days from the effective date of the adopted ordinance ; and
WHEREAS, RCW 36 . 70 . 790 , RCW 36 . 70 . 795 , and RCW 36 . 70A . 390 permit the
adoption of interim official controls as long as a public hearing is held within 60 days of
adoption ; and
WHEREAS, the Council makes the following findings of fact in support of the
adoption of this ordinance:
1 . The emergency interim moratorium imposed by this ordinance is necessary for the
support of county government in its efforts to implement planning for rural lands consistent
with the goals and requirements of the GMA .
2 . Under the normal process, an ordinance is introduced and at least thirteen days
must pass before adoption . In the meantime, permit applications can be filed and become
vested under the existing law . An emergency ordinance, which takes effect immediately
upon adoption , is necessary in the current situation to prevent a potential sudden increase
in the filing of subdivision and/or short subdivision applications in the areas within the
boundaries of the LAMIRDs recommended by the Planning Commission in its October 8,
2009 decision before the ordinance takes effect .
3 . The Whatcom County Council is currently in the process of reviewing its
comprehensive plan , existing zoning densities, and development codes to permanently
address areas of more intensive rural development in the county . This ordinance assures
that this process can be thorough , while satisfying the WWGMHB that the goals and
requirements of the GMA are not compromised .
4 . The Whatcom County Council has specifically considered Section 1 . 11 of the
Whatcom County Charter and finds that the emergency interim moratorium imposed by this
ordinance does not place an undue burden on anyone under that provision as it is
temporary and continues to allow property owners to divide their property into parcels of 10
acres or greater while it is in place .
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that an
emergency interim moratorium is hereby imposed on the acceptance of new applications for
subdivisions and short subdivisions for divisions of property into parcels smaller than 10
acres in the areas within the boundaries of the LAMIRDs recommended by the Planning
Commission in its October 8 , 2009 decision . These areas are depicted as a Rural Center
designation or as a Rural Business designation on the attached maps marked as Exhibit A .
This ordinance does not apply to applications that were complete , as provided by the
Whatcom County Code , prior to the effective date of this ordinance .
BE IT FINALLY ORDAINED that the Whatcom County Council declares that this
ordinance is n�gfigsary for the support of county government and shall take effect
