The resolution clarifies that Ordinance 2012-032 was not intended to remove "electric vehicle rapid charging
station" from the list of accessory uses in the RGC and RIM zones .

RESOLUTION NO . 2012-036
CLARIFYING ACCESSORY USES IN THE RURAL GENERAL COMMERCIAL ( RGC) AND RURAL
INDUSTRIAL MANUFACTURING ( RIM ) ZONES
WHEREAS , State law requires counties to allow electric vehicle infrastructure in their
nonresidential zones ; and
WHEREAS , on January 10 , 2012 , the Whatcom County Council adopted Ordinance No .
2012- 001 , which added " electric vehicle rapid charging station " as an accessory use to
automobile service stations in the RGC and RIM zones (WCC Sections 20 . 59 . 106 and 20 . 69 . 110,
respectively) ; and
WHEREAS , on August 7 , 2012 , the Whatcom County Council adopted Ordinance No .
2012 - 032 , which amended the list of accessory uses in the RGC and RIM zones ; and
WHEREAS , sections 20 . 59 . 106 and 20 . 69 . 110 allowing " electric vehicle rapid charging
station " as an accessory use were inadvertently left out of the list of accessory uses permitted
in RGC and RIM zones in Ordinance 2012 - 032 ; and
WHEREAS , Ordinance 2012 - 032 added " one- story detached accessory storage building "
as an accessory use under 20 . 59 . 106 and 20 . 69 . 110 ; and
WHEREAS , Ordinance 2012 - 032 did not delete " electric vehicle rapid charging station "
from the list of accessory uses in the RGC and RIM zones .
NOW , THEREFORE , BE IT RESOLVED that the Whatcom County Council hereby clarifies
accessory uses in the RGC and RIM zones as follows :
Ordinance 2012 - 032 was not intended to remove " electric vehicle rapid charging station "
from the list of accessory uses in the RGC and RIM zones . Both an " Electric vehicle rapid

charging station " and a " one-story detached accessory storage building " are permitted as
accessory uses in the RGC and RIM zones, and both should be listed under accessory uses in
WCC 20 . 59 . 100 and 20 . 69 . 100 , separately numbered .
