The attached Resolution to Consider Vacating a Portion of Bridgewater Street (Shipyard Road) and Dearborn Avenue is submitted per RCW 58. 17 & 36. 87 and WCC 12-20. Adoption of this resolution will trigger the County Engineer to report on the proposed vacation at a future Council meeting. Once the County Engineer 's report is submitted the road vacation will be considered by Council under a separate resolution and a public hearing will need to be scheduled. COMMITTEE ACTION: COUNCIL ACTION:: 8 / 7 / 2012 : Forwarded to Council for approval 8 / 7 / 2012 : Council Approved 7 -0 Res . 2012-025 • Related County Contract #: Related File Numbers: Ordinance or Resolution Number: Res . 2012-025 Please Note: Once adopted and signed, ordinances and resolutions are available for viewing and printing on the County 's website at: www. co. whatcom. wa. us/council. 1 SPONSORED BY: Consent 2 PROPOSED BY: Public Works 3 INTRODUCTION DATE: 8 / 7 / 2012 4 RESOLUTION NO . 2012-025 5 6 A RESOLUTION TO CONSIDER VACATING A PORTION OF BRIDGEWATER STREET 7 (SHIPYARD ROAD) AND DEARBORN AVENUE 8 . 9 WHEREAS, on June 5 , 2012; Jayme Gilday and Jean Allen, et.al., submitted a petition for the 10 vacation of a portion of Bridgewater Street (Shipyard Road) and Dearborn Avenue lying within the 11 unincorporated area of Whatcom County, accompanied by the penal sum of $682 .00, and, 12 WHEREAS, as described in RCW 36. 87 .010, when a county road or any part thereof is considered 13 useless the Whatcom County Council may declare its intention to formally consider vacation, by 14 resolution. 15 NOW, THEREFORE, BE IT RESOLVED that it is the intention of the Whatcom County 16 Council to consider vacation of the following described right of way: 17 18 That portion of "Plymouth City, Whatcom County, Washington", as per the map thereof, 19 recorded in Book 2 of Plats, Page 56 in the Auditor' s Office of said county and state, more 20 particularly described as follows: 21 22 Commencing at the Northeast corner of a tract of land conveyed to Jayme S . 23 Gilday under Whatcom County Auditor' s File Number 2011203587; thence 24 north 0°00 ' 00" east, 7.50 feet; thence south 89°59 '22" west parallel to the 25 centerline of Bridgewater Street (Shipyard Road), 295 .01 feet to a point of 26 curvature; thence along a curve to the left having a radius of 35 .00 feet 27 through a central angle of 89°59 ' 23" for an arc distance of 54.97 feet to a 28 point of tangency; thence south 0°00 ' 00" west, 104.51 feet to a point of 29 cusp; thence along a curve to the right having a radius of 132 .00 feet the 30 center of which bears north 90°00' 00" east through a central angle of 31 . 90°00 ' 00" east through a central angle of 90°00 ' 38" for arc distance of 32 207.37 feet to a point of tangency and south right of way margin of 33 Bridgewater Street (Shipyard Road); thence north 89°59 '22" east along said 34 margin, 198 .00 feet to the point of beginning. Containing 5 ,950 square feet 35 more or less. 36 37 Subject to and/or together with all easements, covenants, restrictions and/or 38 agreements of record or otherwise.
