SUMMARY STATEMENT OR LEGAL NOTICE LANGUAGE: (If this item is an ordinance or requires a public hearing, you must provide the language for use in the required public notice. Be specific and cite RCW or WCC as appropriate. Be clear in explaining the intent of the action.) Replacement of the ordinance (WCC 1 . 14) in its entirety establishing legal boundaries for all precincts within Whatcom County pursuant to the redistricting mandated by the Legislature following the census to balance the changes in population distribution. State law requires all precinct boundary changes to be completed 14 days prior to candidate filing (April 30, 2012) . Candidate filing week begins May 14, 2012 . Mailing needs to occur by April 27 prior to the standard waiting period for ordinances to take effect. Therefore, an emergency ordinance is requested to enable this waiting period to be waived. COMMITTEE ACTION:: COUNCIL ACTION: 4 / 24 / 2012 : Council Adopted with Substitute Exhibit A 5 -0 , Crawford and Kremen absent Ord . 2012 -020 Related County Contract #: Related File Numbers: Ordinance or Resolution Number: Ord . 2012-020 Please Note: Once adopted and signed, ordinances and resolutions are available for viewing and printing on the County 's website at: www. co. whatcom. wa. us/council PROPOSED BY: AUDITOR SPONSORED BY: CONSENT INTRODUCTION DATE : APRIL 24, 2012 ORDINANCE NO . 2012-020 AN EMERGENCY ORDINANCE REPLACING WHATCOM COUNTY CODE SECTION 1 . 14, ELECTORAL PRECINCTS, WITH NEWLY ESTABLISHED VOTING PRECINCT BOUNDARIES FOR WHATCOM COUNTY WHEREAS, the Congressional boundary line creating a new District # 1 and modifying the boundary line of District # 2 have been passed by the Washington State Legislature based on the decennial census information and recommendations of the State Redistricting Commission ; and WHEREAS, the State Legislative boundary line between the Forty Second (42"d ) , the Fortieth (40th) and Thirty Ninth (39th) have been altered by the Washington State Legislature based on the same decennial census information and the recommendations of the State Redistricting Commission ; and WHEREAS, the Whatcom County Districting Committee has recommended and the County Council has adopted changes to the Whatcom County Council District boundaries as a result ; and WHEREAS, RCW 29A . 16 . 050 ( 1 ) requires every voting precinct must be wholly within a single congressional district, a single legislative district and a single district of the county legislative authority ; and WHEREAS, RCW 29A. 16 . 040 provides the county legislative authority shall divide the county into precincts and establish boundaries for the precincts ; and this statute further provides that no precinct boundary changes may be made starting fourteen ( 14) days prior to the first day candidates may file for the primary election through the period ending with the general election ; and WHEREAS, RCW 29A. 76 . 030 provides the County Auditor shall transfer and notify any registered voters that may be affected by the change in boundaries . NOW, THEREFORE, BE IT ORDAINED by the Whatcom County that this emergency ordinance repeals all previous ordinances establishing voting precinct boundaries for Whatcom County and immediately replaces Whatcom County Code Section 1 . 14, in its entirety, with the newly established voting precinct boundaries outlined in Exhibit A to this ordinance . BE IT FURTHER ORDAINED by the Whatcom County Council that this emergency ordinance is necessary for the support of county government and adoption of this ordinance will allow the Whatcom County Auditor to meet notification deadlines established by the State . BE IT FINALLY ORDAINED that the provisions of this emergency ordinance shall take effect immediately upon approval by the County Executive and shall remain in effect for a period not to exceed 60 days .
